POISONS ACT 1966—REGULATIONS

(Relating to withdrawal or suspension of licence to supply methadone)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Poisons Act 1966, has been pleased to make the Regulation set forth hereunder.

The Poisons Regulations are amended:

(a)

by omitting from Regulation 69 (1) the word "Secretary" wherever occurring and by inserting instead the word "Director-General";

(b) by omitting from Regulation 69 (1) (e) the word "or";

(c)

by inserting after Regulation 69 (1) (f) the following word and paragraph:

; or

(g)

if, in the case of a licence which authorises the supply of methadone, the Director-General is of the opinion that the use of the premises on or from which the methadone is supplied is causing disruption to the amenity of the area in which the premises are situated.

(d)

by inserting in Regulation 69 (2) after the matter "paragraph (1) (f)" the matter "or (g)".

EXPLANATORY NOTE

The object of this Regulation is to amend the Poisons Regulations:

(a) to enable the Director-General of the Department of Health to withdraw or

suspend a licence to supply methadone if the Director-General is satisfied that the use of the premises concerned is causing disruption to the amenity of the area; and

(b) to provide that if the Director-General withdraws or suspends a licence on

such a ground, the Director-General must set out the reasons for withdrawing or suspending the licence when giving written notice to the holder of the licence.
