POISONS ACT 1966 - REGULATION

(Relating to restricted substances)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Poisons Act 1966, has been pleased to make the Regulation set forth hereunder.

Commencement

1. This Regulation commences on 24 August 1990.

Amendments

2. The Poisons Regulations are amended:

(a)

by omitting Regulation 31E(1) and by inserting instead the following paragraph

(1) This regulation applies to the following substances,

namely:

amylobarbitone, androisoxazole, androsterone,

boldenone,
but o bar bito ne,
clostebol,
dehydrotestosterone,

by omitting from Appendix D the matter "Reg. 30(1)." and by inserting instead the matter "Reg. 31.";

(c)

by inserting in Appendix D, in alphabetical order, the following substances:

EXPLANATORY NOTE

The objects of this Regulation are:

(a) to add to the list of substances for which prescriptions must be retained for 2 years by the person who dispenses the prescription; and
(b) to add to the list of prescribed restricted substances under section 16 of the Poisons Act 1966; and
(c) to add to the list of restricted substances which are prescribed for the purposes of section 18A of the Poisons Act 1966.

Section 16 of the Poisons Act 1966 provides that it is an offence for a person (other than a medical practitioner, pharmacist, dentist, veterinary surgeon or certain other authorised persons) to have possession or attempt to obtain possession of prescribed restricted substances.

Section 18A of the Poisons Act 1966 provides that it is an offence for a person to have possession of a quantity of any prescribed restricted substance in excess of the quantity prescribed in respect of that substance.
