POISONS ACT 1966—REGULATION

(Relating to drugs of addiction)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Poisons Act 1966, has been pleased to make the Regulation set forth hereunder.

The Poisons Regulations are amended:

(a) by inserting in the definition of “Public hospital” in Regulation 2 after the words “Public ospitals Act 1929” the words “, a hospital under the control of an area health service constituted under the Area Health Services Act 1986”;
(b) by inserting after Regulation 62A the following Regulation: Exemptions relationg to drugs of addiction

62 AAA. (1) This regulation applies to all drugs of addiction other than those referred to in Regulation 62A.

(2) A medical practitioner is authorised to prescrib drug of addiction to which this Regulation applies for or to a person referred to in section 28 (a) or (b) of the Act without the Director-General’s authority under section 29 of the Act if:

(a)

the medical practitioner is of the opinion that the person requires the use of the drug in the course of treatment as an in-patient in a public hospital; and

(b)

such presciption or supply is for a period not exceeding 14 consecutive days following admission of the person as an in-patient.

EXPLANATORY NOTE

The object of this Regulation is to amend the Poisons Regulations:

(a) to enable a medical practitioner to prescribe or supply a drug of addiction (except certain drugs such as amphetamines) to a person without the prior authority of the Director-General of the Department of Health if the medical practitioner is of the opinion that the person requires the use of the drug as an in-patient in a public hospital and the prescription or supply is for no more than 14 days; and
(b) to provide that hospitals under the control of area health services fall within the definition of “public hospital” for the purposes of the Poisons Regulations (this being consistent with other legislation).
