Her Excellency the Governor, with the advice of the Executive Council, has made the following

Regulation under the Point to Point Transport (Taxis and Hire Vehicles) Act 2016.

Explanatory note

The objects of this Regulation are:

(a) to provide for the use of digital driver licences by the drivers of taxis and hire vehicles, and
(b) to make it clear that a taxi zone includes any area of road to which a taxi zone sign applies.

This Regulation is made under the Point to Point Transport (Taxis and Hire Vehicles) Act 2016, including section 158 (the general regulation-making power) and clauses 2(2)(e) and 5(1) of Schedule 1.

1      Name of Regulation

This Regulation is the Point to Point Transport (Taxis and Hire Vehicles)

Amendment (Digital Driver Licences) Regulation 2019.

2      Commencement

This Regulation commences on the day on which it is published on the NSW legislation website.

3 Amendment of Point to Point Transport (Taxis and Hire Vehicles) Regulation 2017

(1) Clause 3 Definitions

Omit the definition of taxi zone from clause 3(1). Insert instead—

taxi zone has the same meaning as in the Road Rules 2014 and includes

a taxi zone appointed under clause 93.

(2) Clause 71 Driver to provide driver licence for inspection
Omit clause 71(1). Insert instead—
(1) If an authorised officer requests a driver of a passenger vehicle to
produce the driver’s driver licence, the driver must—
(a) hand the driver’s driver licence to the authorised officer for inspection, or
(b) display the driver’s digital driver licence.

Note. Section 61C of the Road Transport Act 2013 sets out the requirements for the display of a digital driver licence.

Maximum penalty—10 penalty units.
