JUDGMENT
HIS HONOUR: In this matter I give leave to appeal. The

appeal is allowed in part. The decision of the Tribunal is
varied by reducing the amount ordered to be paid by the
appellant to the respondents from $113,513 to $95,467.04. The
appeal is otherwise dismissed.

I order the appellant to pay the respondents' costs of the appeal to be assessed.
I have already ordered that the appellant will pay the
respondents' costs of the appeal. The ascertainment of those
