s1 2 s3 Podiatrists Amendment (No. 1) No. 270, 1994 ˙ Short title 1. This by-law may be cited as the Podiatrists Amendment By-law (No. 1) 1994 . ˙ By-law amended 2. This by-law amends the Podiatry By-law 1988 . ˙ Replacement of Pt 1 (Preliminary) 3. Part 1— omit, insert PART 1—PRELIMINARY ˙ Short title ‘1. This by-law may be cited as the Podiatrists By-law 1988 . ˙ Definitions 2. In this by-law— “advertise” means advertise a practice, or advertise a person as being a podiatrist, by— (a) placing an advertisement in a newspaper or professional journal; or (b) placing an entry in a directory; or (c) distributing a circular; or (d) displaying a sign or nameplate; or (e) using printed stationery; or (f) doing any other thing; “practice” means a podiatry practice.
s4 3 s5 Podiatrists Amendment (No. 1) No. 270, 1994 ˙ Forms 3. The Board may approve forms for use under the Act. ˙ Fees 4. The fees payable for the purposes of the Act are set out in the Schedule.’. ˙ Omission of s 16 (Practice) 4. Section 16— omit . ˙ Replacement of Pts 4 and 5 5. Parts 4 and 5— omit, insert PART 4—PRACTICE ˙ Advertising 17.(1) A podiatrist must not advertise in a way that— (a) is false, misleading or deceptive; or (b) is vulgar or sensational in a way that would be likely to affect adversely the standing of the profession; or (c) is otherwise unprofessional. (2) A podiatrist must not include in an advertisement— (a) a self-laudatory statement; or (b) an endorsement of, or testimonial about, the podiatrist or the podiatrist’s practice; or (c) a reference to fees. Maximum penalty—20 penalty units.
s5 4 s5 Podiatrists Amendment (No. 1) No. 270, 1994 ˙ Practice names 18. A podiatrist must not practise under a name other than— (a) the podiatrist’s name; or (b) if the podiatrist is a member of a partnership and the name of the partnership consists only of the names of its members or former members—the name of the partnership; or (c) a name approved by the Board. Maximum penalty—20 penalty units. ˙ Approval of practice names 19.(1) A podiatrist may apply to the Board for approval of the name under which the podiatrist proposes to practice. (2) The application must be in writing and accompanied by the prescribed fee. (3) The Board may approve a proposed name for a practice only if it is satisfied the name— (a) does not indicate a particular specialty or special interest of podiatry is practised at the practice; and (b) is not misleading as to the nature of the practice; and (c) is not vulgar or sensational in a way that would be likely to affect adversely the standing of the profession; and (d) does not imply superiority for the practice over other practices; and (e) is not otherwise unprofessional. ˙ Canvassing or soliciting 20. A podiatrist must not— (a) canvass or solicit work as a podiatrist; or (b) allow a person to canvass or solicit work for the podiatrist. Maximum penalty—20 penalty units.’.
