Building Act 1993

Plumbing Amendment Regulations 2014

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Plumbing Regulations 2008—

(a)to replace references to the Plumbing Industry Commission with references to the Victorian Building Authority; and

(b)to update other references to reflect recent amendments to the Building Act 1993; and

(c)to convert certain fees payable under Part 12A of the Building Act 1993 from monetary amounts to fee units so as to enable the automatic indexation of those fees under the Monetary Units Act 2004; and

(d)to make other miscellaneous amendments.

2Commencement

These Regulations come into operation on 30 June 2014.

3Authorising provisions

These Regulations are made under sections 221ZZZV and 262 of the Building Act 1993.

4Principal Regulations

In these Regulations, the Plumbing Regulations 2008[1] are called the Principal Regulations.

5Definitions

In regulation 5 of the Principal Regulations—

(a)in the definition of approved competency units, for "Commission" substitute "Authority";

(b)the definition of Commission is revoked.

6Meaning of plumbing work

Regulation 10(2)(a)(ii) of the Principal Regulations is revoked.

7Terms used in this Part

For regulation 19(c) of the Principal Regulations substitute

"(c)AS/NZS 5601.1 Gas installations Part 1: General installations, as issued, published or remade from time to time;

(d)AS/NZS 5601.2 Gas installations Part 2: LP Gas installations in caravans and boats for non-propulsive purposes, as issued, published or remade from time to time.".

8Roofing (stormwater) work defined

In regulation 30(1) of the Principal Regulations, for "and any part" substitute "or any part".

9Competency units

(1)In the heading to regulation 42 of the Principal Regulations, for "Commission" substitute "Authority".

(2)In regulation 42 of the Principal Regulations, for "Commission" (wherever occurring) substitute "Authority".

10Price of compliance certificate

In regulation 45 of the Principal Regulations, for "$31.25" substitute "2×43 fee units".

11Exemption from fees

In regulation 46 of the Principal Regulations, for "Commission" substitute "Authority".

12Requirements for residential heating, cooling and air-conditioning equipment

(1)In clause 5 of Schedule 2 to the Principal Regulations, before "Commission" insert "Plumbing Industry".

(2)At the foot of clause 5 of Schedule 2 to the Principal Regulations insert

"Note

The Victorian Building Authority became the successor in law to the Plumbing Industry Commission on 1 July 2013.".

13Requirements for refrigerated air-conditioning work

(1)In clause 7(c) of Schedule 2 to the Principal Regulations, before "Commission" insert "Plumbing Industry".

(2)At the foot of clause 7(c) of Schedule 2 to the Principal Regulations insert

"Note

The Victorian Building Authority became the successor in law to the Plumbing Industry Commission on 1 July 2013.".

14Schedule 3 amended

In Schedule 3 to the Principal Regulations, for "Commission's" (wherever occurring) substitute "Authority's".

15Schedule 4 amended

In Schedule 4 to the Principal Regulations—

(a)in Item 1, in Column 3, for "$49.38" substitute "3×84 fee units";

(b)in Item 2, in Column 3, for "$274.47" substitute "21×37 fee units";

(c)in Item 3, in Column 3, for "$309.62" substitute "24×11 fee units";

Fee Units

These Regulations provide for fees by reference to fee units within the meaning of the Monetary Units Act 2004.

The amount of the fee is to be calculated, in accordance with section 7 of that Act, by multiplying the number of fee units applicable by the value of a fee unit.

The value of a fee unit for the financial year commencing 1 July 2013 is $12.84.  The amount of the calculated fee may be rounded to the nearest 10 cents.

The value of a fee unit for future financial years is to be fixed by the Treasurer under section 5 of the Monetary Units Act 2004.  The value of a fee unit for a financial year must be published in the Government Gazette and a Victorian newspaper before 1 June in the preceding financial year.
