Plumbers Licensing and Plumbing Standards

Amendment Regulations (No. 3) 2016

Made by the Governor in Executive Council.

1.            Citation

These regulations are the Plumbers Licensing and Plumbing
Standards Amendment Regulations (No. 3) 2016.

2.            Commencement

These regulations come into operation as follows —

(a)	regulations 1 and 2 — on the day on which these regulations are published in the Gazette;
(b)	the rest of the regulations — on the day the Water Services Legislation Amendment Regulations 2016 regulation 3 comes into operation.

3.            Regulations amended

These regulations amend the Plumbers Licensing and Plumbing
Standards Regulations 2000.

4.            Regulation 3 amended

(1) In regulation 3(1) insert in alphabetical order:

drainage plumbing diagram means a diagram of

drainage plumbing work —

(a)	given to the Board under regulation 45D; or
(b)	that is otherwise in the possession of the Board;

(2)	In regulation 3(1) in the definition of certificate of compliance paragraph (a) delete "42 or 44; or" and insert:
42, 44 or 45B; or
(3)	In regulation 3(1) in the definition of minor plumbing work delete paragraphs (e) and (1) and insert:

(e) the maintenance, repair or replacement of

existing drainage plumbing;

5.            Part 5 Division 3A heading replaced

Delete the heading to Part 5 Division 3A and insert:

Division 2A - Plumbing work including
performance solutions

6.             Part S Division 213 inserted

Before Part 5 Division 3 insert:

Division 2B - Drainage plumbing diagrams for

drainage plumbing work

45D. Drainage plumbing diagram to be given to Board

(1) A licensed plumbing contractor who carries out

drainage plumbing work referred to in

subregulation (2) must give the Board a diagram of the

work -

(a)	in the approved form;
(b)	at the same time as a certificate of compliance for the work is given to the Board under regulation 42 or 45B.

Penalty for this subregulation: a fine of $ 5 000.
(2) Drainage plumbing work for which a diagram must be

given is work that involves the installation, alteration
or extension of underground pipes and other fittings

used or intended to be used for the carrying of—

(a)	wastewater to a sewer; or
(b)	wastewater or other waste to an apparatus for the treatment of sewage.

45E.	Application to obtain copy of drainage plumbing diagram A person may request a copy of a drainage plumbing diagram by applying to the Board in the approved form.
45F.	Copy of drainage plumbing diagram may be provided
(1)	The Board may, for any purpose described in subregulation (2), provide a copy of a drainage plumbing diagram to a person who makes an application under regulation 45E.
(2)	The purposes referred to in subregulation (1) are -

(a)	the regulation and control of plumbing work; and
(b)	the maintenance of standards to be observed in, or in connection with, the carrying Out of plumbing work.

7.            Regulation 75 amended

In regulation 75(3) in the Table in column 1 delete "70(1),
70(3)" and insert:

45D(1), 70(1), 70(3)

8.            Regulation 106 amended

(1)	In regulation 106(2) delete "42(1) and 44(1) -" and insert:
42(1), 44(1), 45A(l) and 4513(l) -

(2) In regulation 106(3):

(a) delete "42(1) and 44(1)" and insert:

42(1), 44(1), 45A(1) and 45B(1)

(b) delete "12 or 13." and insert:

12, 13 or 16A.

9.           Schedule 1 amended

(1) Delete the reference after the heading to Schedule 1 and insert:

[r. 3, 22, 45A, 45,54,73 and 102]

(2) Delete Schedule 1 items 16A to 16C and insert:

15A.	Combined notice of intention and certificate
of compliance to carry out work that includes performance solution (regulation 45A(1) and 45B(1)) — 1 notice/certificate 22.75
15B.	Lodgment fee for notice of intention to carry out work that includes performance solution (regulation 45A(3)) 780.00
15C.	Application for declaration for
non-application or modification of plumbing
standards (regulation 54) 780.00

10.          Schedule 4 amended

In Schedule 4 Form 1 delete "Plum bing compliance officer who issued

this notice" and insert:

Authorised person who issued this notice
