Board (Amendment) Regulations 1997
The Governor in Council makes the following Regulations:

1. Objectives
The objectives of these Regulations are to make various changes to the Plumbers Gasfitters and Drainers Registration Board Regulations 1988 as
a result of the enactment of the Building
(Amendment) Act 1996.
2. Authorising provision
These Regulations are made under section
221ZZZV of the Building Act 1993.
3. Commencement
These Regulations come into operation on 24
March 1997.
4. Principal Regulations
Plumbers Gasfitters and Drainers Registration Board

In these Regulations the Plumbers Gasfitters and
Drainers Registration Board Regulations 19881are called the Principal Regulations.
5. Substitution of regulation 4
For regulation 4 of the Principal Regulations
substitute—"4. Objective
The objective of these Regulations is to give
effect to Part 12A of the Building Act1993.". 2
6. Changes to definitions
In regulation 5 of the Principal Regulations—
(a)
for the definition of "Act" substitute— ' "Act" means the Building Act 1993;';
(b)
before the definition of "sewer" insert— ' "prescribed authority" means—
(a) GASCOR; or
(b)
a company that holds a water licence or a water and sewerage licence under the Water Industry Act 1994; or
(c)
an Authority that has a water district or a sewerage district under the Water Act 1989; or
(d)
any public statutory body that was a predecessor of any body listed in paragraph (a), (b) or (c);'.

7. Consequential amendments
(1) For the heading to Part 2 of the Principal
Regulations substitute—
"PART 2—CLASSES OF PLUMBING WORK".
(2) After regulation 6(f) of the Principal Regulations
insert—
'; and
(g) "Plumbing (Draining)" which is work carried renewal, replacement, alteration, repair or maintenance of underground pipes, fittings or appliances that carry, or are intended to carry—
(i) sewage or waste (including waterborne waste) to a sewer or drain; or
(ii) sewage or trade waste to or from a septic tank or other treatment plant; or
(iii) stormwater to a storm water drain; or
(iv) stormwater within a property.'.
(3) Regulations 7, 8 and 9 of the Principal
Regulations are revoked.
(4) Part 4 of the Principal Regulations is revoked.
8. Substitution of regulations 12–14
For regulations 12, 13 and 14 of the Principal
Regulations substitute—"12. Experience needed to be able to be licensed
or registered as a plumber
(1) The experience required for the purposes of section 221M, 221N or 221O of the Act to be able to be licensed or registered to carry

out a particular class of plumbing work or
specialised plumbing work is—
(a) the completion of an apprenticeship of not less than 4 years in plumbing work of that class under the supervision of a plumber qualified to carry out work of that class; or (b) employment for not less than 4 years in plumbing work of that class by a plumber qualified to carry out work of that class. (2) For the purposes of this section, a plumber is
qualified to carry out work of a particular
class if the plumber—
(a) class under the Building Control
was registered to carry out work of that Act 1981 before 24 March 1997; or
(b)
is licensed to carry out that class of work.
(3) Despite sub-regulation (1), in the case of
Plumbing (Draining), the following is sufficient experience to be able to be licensed or registered to carry out that
work—
(a)
employment for not less than 2 years in Plumbing (Draining) work by a plumber qualified to carry out that work; or
(b)
the performance of draining work for a period of not less than 2 years in an area under the control of a prescribed authority that did not issue Drainers Licences before 1 December 1988, if the prescribed authority (or a successor

body to the prescribed authority)

| provides proof of the person's competence to the satisfaction of the Board. |
(4) Despite sub-regulation (1), in the case of
Plumbing (Duct Fixing), employment for not less than 2 years in Plumbing (Duct Fixing) work by a plumber qualified to carry out that work is sufficient experience to be able to be licensed or registered to carry out that work.
(5) Despite sub-regulation (1), in the case of a
person who is qualified to carry out work of
a particular class and who seeks to be
licensed or registered to carry out another
class of plumbing work, employment for not
less than 1 year in work of that other class by
a plumber qualified to carry out work of that
other class is sufficient experience to be able
to be licensed or registered to carry out that
other class of work.
(6) For the purposes of this regulation, the
required experience may be obtained over more than one period and with more than one employer.".
9. Updating of references relating to required qualifications
In the Principal Regulations—
(a) "The prescribed qualification for the
purposes of section 92 of the Act is a pass
in—"
substitute—in regulation 15, for— of section 221O of the Act (other than for Plumbing (Draining) work) is a pass in—";

(b) "The prescribed qualification for the
purposes of section 94 of the Act is a pass
in—"
substitute—in regulation 16, for— of section 221O of the Act for Plumbing (Draining) work is a pass in—";
(c) "The prescribed qualification for the
purposes of section 93 of the Act is a pass
in—"
substitute—in regulation 17, for— of section 221M or 221N of the Act (other than for Plumbing (Draining) work) is a pass in—";
(d) "The prescribed qualification for the
purposes of section 94A of the Act is—"
substitute—in regulation 18, for— of section 221M or 221N of the Act for Plumbing (Draining) work is—".
10. Substitution of Parts 7–11
For Parts 7, 8, 9, 10 and 11 of the Principal
Regulations substitute—
"PART 7—OTHER MATTERS
19. Licence and registration documents must be returned on demand

(1) A person who holds a licence or certificate
of registration must return it to the Registrar as soon as is practicable after being asked to do so by the Registrar.
(2) The Registrar may only ask for the return of a licence or certificate of registration under this regulation—
(a)
for the purpose of altering the details on the document; or
(b) for any purpose permitted by the Act.
20. Advertising must contain identification
details(1) If a licensed plumber carries out any form of
advertising with respect to plumbing work,
he or she must ensure that the advertising
includes—
(a) his or her name;
(b)
if he or she operates under a business name, that name; and
(c) his or her licence number.
(2) If a registered plumber carries out any form
of advertising with respect to plumbing
work, he or she must ensure that the
advertising includes—
(a) his or her name;
(b)
if he or she operates under a business name, that name; and
(c)
the number of his or her certificate of registration.
21. Licence to be shown on demand licence for inspection if asked to do so by—

(a) any person with whom the holder has entered into a contract to carry out plumbing work or to whom the holder has made a statement indicating that the holder is willing or prepared to carry out plumbing work or to enter into a contract to carry out such work; or (b) the owner or occupier of any land, building, vehicle or vessel on or in which the holder is carrying out plumbing work or in respect of which
the holder has entered into a contract to
carry out plumbing work or to whom
the holder has made a statement
indicating that the holder is willing or
prepared to carry out plumbing work or
to enter into a contract to carry out such
work; or(c) any person authorised in writing for the purpose of this regulation by the Board; or (d) any person authorised in writing for the purpose of this regulation by any body that is responsible for the control of plumbing work that the holder is
carrying out.22. Certificate of registration to be shown on demand
The holder of a certificate of registration must produce the certificate for inspection if asked to do so by—
(a) the owner or occupier of any land, building, vehicle or vessel on or in which the holder is carrying out plumbing work; or

(b)
any person authorised in writing for the purpose of this regulation by the Board; or
(c)
any person authorised in writing for the purpose of this regulation by any body that is responsible for the control of
plumbing work that the holder is
carrying out.".
11. Repeal of redundant Schedules
Schedules A, B, C, D, E, F, G, H, I, J and K of the
Principal Regulations are revoked.
