    Editorial changes

    The Legislation Act 2001, part 11.3 authorises the Parliamentary Counsel to make editorial amendments and other changes of a formal nature when preparing a law for republication. Editorial changes do not change the effect of the law, but have effect as if they had been made by an Act commencing on the republication date (see Legislation Act 2001, s 115 and s 117). The changes are made if the Parliamentary Counsel considers they are desirable to bring the law into line, or more closely into line, with current legislative drafting practice.

    This republication does not include amendments made under part 11.3 (see endnote 1).

    Uncommenced provisions and amendments

    1. Name of regulation

      This regulation is the Plastic Shopping Bags Ban Regulation 2011.

    4. Biodegradable bag—Act, dict, def biodegradable bag

      (1)The requirement that a plastic bag is made from plastic compostable in accordance with AS 4736-2006 (Biodegradable plastics‑Biodegradable plastics suitable for composting and other microbial treatment) as in force from time to time is prescribed.

      (2)The Legislation Act, section 47 (6) does not apply to AS 4736-2006.

      NoteAS 4736-2006 does not need to be notified under the Legislation Act because s 47 (6) does not apply (see Legislation Act, s 47 (7)). The standard may be purchased at s 3)

      Note 2For example, the Legislation Act, dict, pt 1, defines the following terms:

      ·     Australian Standard (see s 164 (1)).

      AS 4736-2006  means Australian Standard AS 4736-2006 (Biodegradable plastics—Biodegradable plastics suitable for composting and other microbial treatment), as in force from time to time.
