Regulation under the Plantations and Reafforestation Act 1999.

Explanatory note

The object of this Regulation is to update a reference to the document known as Planning for Bush Fire

Protection with the November 2019 version, which is used for the purposes of a complying development
standard relating to establishment operations for certain plantations.

This Regulation is made under the Plantations and Reafforestation Act 1999, including sections 27, 29(3) and 70 (the general regulation-making power).

1      Name of Regulation

This Regulation is the Plantations and Reafforestation (Code) Amendment (Planning

for Bush Fire Protection) Regulation 2020.

2      Commencement

This Regulation commences on 1 March 2020 and is required to be published on the
NSW legislation website.

3 Amendment of Plantations and Reafforestation (Code) Regulation 2001

(1) Clause 6

Insert after clause 5—

6      Savings provision—Planning for Bush Fire Protection

The amendment to clause 25A of the Plantations and Reafforestation

Code made by the Plantations and Reafforestation (Code) Amendment (Planning for Bush Fire Protection) Regulation 2020 does not apply in

relation to an application for authorisation of a complying plantation under the Plantations and Reafforestation Act 1999 made, but not determined, before 1 March 2020.

(2)	Appendix Plantations and Reafforestation Code
Omit “ISBN 0 9751033 2 6, prepared by the NSW Rural Fire Service in co-operation with the Department of Planning, dated December 2006” from the definition of
Planning for Bush Fire Protection in clause 25A(6).
Insert instead “ISBN 978 0 646 99126 9, prepared by the NSW Rural Fire Service in co-operation with the Department of Planning, Industry and Environment, dated November 2019”.
