Plant Quarantine Amendment Act 2007

An Act to amend the Plant Quarantine Act 1997

[Royal Assent 13 December 2007]

Be it enacted by His Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:

1Short titleThis Act may be cited as the Plant Quarantine Amendment Act 2007 . 2CommencementThis Act commences on the day on which this Act receives the Royal Assent. 3Principal ActIn this Act, the Plant Quarantine Act 1997 is referred to as the Principal Act. 4Section 101A insertedAfter section 101 of the Principal Act , the following section is inserted in Division 6: 101AFalse or misleading statements (1)  A person must not, in making any application or giving any information under this Act – (a) make a statement knowing it to be false or misleading; or (b) omit any matter from a statement knowing that without that matter the statement is misleading.

Penalty:  Fine not exceeding 50 penalty units.

(2)  A person must not make any statement about a plant, plant product, agricultural or other equipment, premises, organism, pest or disease or the production, importation into the State or movement of a plant, plant product, agricultural or other equipment, organism, pest or disease that is false, or misleading, and likely to cause a person who relies on the statement to commit an offence under this Act.

Penalty:  Fine not exceeding 50 penalty units.

(3)  A person must not make a statement that is false or misleading in answer to a question or inquiry by an inspector or the Secretary.

Penalty:  Fine not exceeding 50 penalty units.
