s1 2 s2 Plant Protection (Papaya Fruit Fly Introduction No. 478, 1997 Prohibition) ˙ Short title 1. This regulation may be cited as the Plant Protection (Papaya Fruit Fly Introduction Prohibition) Regulation 1997 . ˙ Control over introduction of pests—Act, s 8(1) 2.(1) A person must not introduce into Queensland— (a) papaya fruit fly; or (b) a plant infested with papaya fruit fly; or (c) fruit grown in, or despatched from, the area within 50 km of the place in the Northern Territory situated at latitude 12° 24' 20" south and longitude 130° 55' 7" east. (2) Subsection (1)(c) does not apply to fruit— (a) accompanied by a certificate for the fruit issued by an inspector of the Northern Territory agricultural department stating that the fruit— (i) is in a condition approved as a non-host fruit condition for papaya fruit fly; or (ii) is of a species and cultivar approved as a non-host to papaya fruit fly; or (iii) has been treated in an approved way; and (b) packed in a container marked with— (i) if the fruit was treated in an approved way— (A) the date the fruit was treated; and (B) the words ‘Treated for PFF’ or ‘TF/PFF’; and (ii) if the fruit was not treated in an approved way—the date the fruit was packed for introduction into Queensland; and (iii) the name and postal address of the person carrying on the business that packed or despatched the fruit. (3) A marking on a container must be— (a) in letters at least 5 mm high; and

(4) In this section— “approved” means approved by the chief executive or an inspector. “Northern Territory agricultural department” means the department of government of the Northern Territory responsible for administering matters relating to agriculture in the Northern Territory.
