s1 3 s3 Plant Protection Legislation Amendment (No. 1) No. 96, 1999 PART 1—PRELIMINARY ˙ Short title 1. This regulation may be cited as the Plant Protection Legislation Amendment Regulation (No. 1) 1999 . PART 2—AMENDMENT OF PLANT PROTECTION (BANANA BLACK SIGATOKA) QUARANTINE REGULATION 1997 ˙ Regulation amended in pt 2 2. This part amends the PlantProtection(BananaBlackSigatoka)Quarantine Regulation 1997 . ˙ Insertion of new pt 2 3. After section 1— insert— PART 2—TORRES STRAIT ISLANDS ˙ Definitions for pt 2 2. In this part— “banana plant” means a plant of the genus Musa , other than a banana black Sigatoka resistant cultivar mentioned in the schedule, but does not include the fruit of the plant. “pest quarantine area” means the pest quarantine area declared under section 3.

The area within the following boundary is declared to be a pest quarantine area— from latitude 10°28' south, longitude 142° east to latitude 10°28' south, longitude 143° east to latitude 10°47' south, longitude 143°east to latitude 10°47' south, longitude 142°46' east to latitude 10°36' south, longitude 142°27' east to latitude 10°52' south, longitude 142°10' east to latitude 10°52' south, longitude 142° east to latitude 10°28' south, longitude 142° east. 1 ˙ Objects of quarantine 4. The objects of the quarantine for the pest quarantine area are— (a) to prevent the banana black Sigatoka pest being spread in Queensland; and (b) to eradicate the banana black Sigatoka pest in the pest quarantine area. ˙ Restriction on moving, planting and cultivating banana plants 5. A person must not, without an inspector’s approval— (a) move a banana plant out of the pest quarantine area; or (b) move a banana plant from a parcel of land in the pest quarantine area to another parcel of land in the area; or 1 Copies of a map showing the boundary of the pest quarantine area are available for inspection during office hours at— (a) the department’s head office at 80 Ann Street, Brisbane; and (b) the office of the Australian Quarantine and Inspection Service at the ground floor of the Pearl’s Building, Victoria Parade, Thursday Island.
s3 5 s3 Plant Protection Legislation Amendment (No. 1) No. 96, 1999 (c) plant a banana plant in the pest quarantine area; or (d) cultivate a banana plant in the pest quarantine area. ˙ Restriction on moving appliances and other things 6. A person must not, without an inspector’s approval, move an appliance or other thing that has been in contact with a banana plant— (a) out of the pest quarantine area; or (b) from a parcel of land in the pest quarantine area to another parcel of land in the area. ˙ Treatment of banana plants 7.(1) This section applies to an owner of land in the pest quarantine area who grows a banana plant on the land. (2) The owner must treat, or allow an inspector to treat, each banana plant growing on the land as follows— (a) treat the leaf tissue that is dead or not green in colour by— (i) burning it; or (ii) burying it under at least 600 mm of soil; (b) treat the pseudostem and leaf tissue, other than leaf tissue that is dead or not green in colour, by— (i) cutting them into pieces of no more than 600 mm in length; and (ii) leaving the pieces to rot on the surface of the soil or burying them under at least 1 m of soil; (c) treat the corm, suckers and butt of each pseudostem by— (i) removing them from the soil, cutting them into pieces of no more than 50 mm in diameter and either— (A) leaving the pieces to rot on the surface of the soil; or (B) burying them under at least 1 m of soil; or
s4 6 s6 Plant Protection Legislation Amendment (No. 1) No. 96, 1999 (ii) injecting each pseudostem at a height of 30 cm above the ground with a 3.6% solution of glyphosate solution at a rate of 15 ml for each pseudostem and spraying any regrowth with a 0.2% solution of 2,4-D.’. ˙ Amendment of pt 3, s 4 (Definitions for pt 3) 4. Section 4, definition “pest quarantine area” , ‘section 5’— omit, insert— ‘section 9’. ˙ Renumbering of ss 4–8 5. Part 3, sections 4 to 8— renumber as sections 8 to 12. ˙ Replacement of schedule 6.
