This regulation may be cited as the Plant Protection (Banana Pest Quarantine) Amendment Regulation (No. 1) 2000 . ˙ Regulation amended 2. This regulation amends the PlantProtection(BananaPestQuarantine) Regulation 1999 . ˙ Amendment of pt 4, div 3 (Movement of banana plants, soil and appliances) 3. Part 4, division 3, heading— omit, insert— ‘ Division 3—Movement of banana plants, soil, appliances and other things ’. ˙ Replacement of s 9 (Restriction on moving soil and appliances) 4. Section 9— omit, insert— ˙ ‘ Restriction on moving soil, appliances and other things ‘ 9.(1) A person must not, without an inspector’s approval, move soil on which a banana plant has been growing or an appliance or other thing that has been in contact with an infested plant or soil on which an infested plant has been growing— (a) into a pest quarantine area; or (b) from a parcel of land in a pest quarantine area to another parcel of land in the area; or (c) out of a pest quarantine area. ‘ (2) In this section— “infested plant” means a banana plant infested with a notifiable pest mentioned in schedule 2, part 1.

After part 4— insert— ‘ PART 4A—PEST CONTROL MEASURES FOR MOVEMENT OF FRUIT ˙ ‘ Restriction on moving fruit ‘ 10A.(1) This section applies to fruit of a banana plant growing within 50 km of a place (the “restricted area” ) where any of the following pests have been found— (a) banana bacterial wilt; (b) banana black Sigatoka; (c) banana blood disease; (d) banana bugtok disease; (e) banana moko disease. ‘ (2) A person must not, without an inspector’s approval, move the fruit— (a) out of the restricted area; or (b) from a parcel of land in the restricted area to another parcel of land in the area.’. ˙ Amendment of sch 6 (Dictionary) 6. Schedule 6— insert — ‘ “restricted area” see section 10A.’.
