This regulation may be cited as the Plant Protection (Banana Black Sigatoka) Quarantine Amendment Regulation (No. 1) 1998 . ˙ Regulation amended 2. This regulation amends the Plant Protection (Banana Black Sigatoka)Quarantine Regulation 1997 . ˙ Insertion of new pt 1 hdg 3. s6 3 s6 Plant Protection (Banana Black Sigatoka) Quarantine Amendment (No. 1) No. 227, 1998 PART 3—WATTLE HILLS ˙ Definitions for pt 3 4. In this part— “banana plant” means a plant of the genus Musa , other than a banana black Sigatoka resistant cultivar mentioned in the schedule, and includes the fruit of the plant. “pest quarantine area” means the pest quarantine area declared under section 5. ˙ Pest quarantine area ‘5. The area within a 50 km radius of the point at latitude 12°34' south and longitude 143°04' east is declared to be a pest quarantine area. ˙ Objects of quarantine 6. The objects of the quarantine are— (a) to prevent the banana black Sigatoka pest being spread in Queensland; and (b) to eradicate the banana black Sigatoka pest in the pest quarantine area. ˙ Restriction on moving, planting and cultivating plants 7. A person must not, without an inspector’s approval— (a) move a banana plant out of the pest quarantine area; or (b) move a banana plant (other than the fruit of the plant) from a parcel of land in the pest quarantine area to another parcel of land within the area; or (c) plant a banana plant in the pest quarantine area; or (d) cultivate a banana plant in the pest quarantine area.
s6 4 s6 Plant Protection (Banana Black Sigatoka) Quarantine Amendment (No. 1) No. 227, 1998 ˙ Owner of land to treat banana plants 8.(1) This section applies to an owner of land who grows a banana plant within 5 km of a place where the banana black Sigatoka pest has been found in the pest quarantine area. (2) The owner must treat each banana plant growing within 5 km of the place as follows— (a) treat the leaf tissue that is dead or not green in colour by— (i) burning it; or (ii) burying it under at least 600 mm of soil; (b) treat the corm, suckers and butt of each pseudostem by— (i) removing them from the soil; and (ii) cutting them into pieces of not more than 50 mm diameter; and (iii) leaving the pieces to rot on the surface of the soil; (c) treat the pseudostem and leaf tissue (other than leaf tissue that is dead or not green in colour) by— (i) cutting them into pieces not more than 600 mm long; and (ii) leaving the pieces to rot on the surface of the soil.
