s1 2 s3 Plant Protection (Bactrocera Philippinensis) No. 1, 1998 ˙ Short title 1. This notice may be cited as the Plant Protection (Bactrocera Philippinensis) Notice 1998 . 1 ˙ Prescription of pest—Act, s 4(2) 2. Bactrocera philippinensis is a pest for the purposes of the Act. ˙ Control over introduction of pests—Act, s 8(1) 3.(1) A person must not introduce into Queensland— (a) bactrocera philippinensis; or (b) a plant infested with bactrocera philippinensis; or (c) fruit grown in, or despatched from, the area within 50 km of the place in the Northern Territory, near Darwin, situated at latitude 12° 24' 20" south and longitude 130° 55' 7" east. (2) Subsection (1)(c) does not apply to— (a) fruit that is of a species and cultivar approved as a non-host of bactrocera philippinensis; or (b) fruit— (i) accompanied by a certificate for the fruit issued by an approved person stating that the fruit has been treated in an approved way, including for example, that the fruit has been sorted to meet an approved non-host condition; and (ii) packed in a container marked with— (A) the words ‘Treated for fruit fly’ or ‘TF/FF’; and (B) the date the fruit was treated; and (C) the name and postal address of the person carrying on the business that treated the fruit. 1 This notice remains in force until whichever of the following first happens— (a) the commencement of a replacement regulation; (b) the end of 21 days: see sections 4(3) and 8(3) of the Act.
s3 3 s3 Plant Protection (Bactrocera Philippinensis) No. 1, 1998 (3) A marking on a container must be— (a) in clearly legible letters of at least 5 mm high; and (b) indelible; and (c) in a position on the outside of the container that can be clearly seen. (4) In this section— “approved” means approved by the chief executive or an inspector. “approved person” means— (a) a person approved by the chief executive; or (b) an inspector of the department of government of the Northern Territory responsible for administering matters relating to agriculture in the Northern Territory. “bactrocera philippinensis” means the organism Bactrocera philippinensis Drew and Hancock.
