Plant Protection Amendment Regulation (No. 2) 2010 [s 1] 1 Short title This regulation may be cited as the Plant Protection Amendment Regulation (No. 2) 2010 . Editor’s note — See the note to the Plant Protection (Myrtle Rust) Quarantine Notice 2010 , section 1, about the expiry of the notice on the commencement of a regulation under section 11(1) of the Act. 2 Regulation amended This regulation amends the Plant Protection Regulation 2002. 3 Renumbering of s 169 (Notification of new restrictions for restricted area) Section 169— renumber as section 173. 4 Insertion of new ch 3, pt 18 After section 168A— insert— ‘Part 18 Myrtle rust ‘169 Definitions for pt 18 ‘In this part— myrtle rust means the pest Uredo rangelii (J.A. Simpson, K. Thomas and C.A. Grgurinovic). pest quarantine area means the pest quarantine area declared under section 170. ‘170 Declaration of pest quarantine area ‘The whole of Queensland is declared to be a pest quarantine area for myrtle rust. Plant Protection Amendment Regulation (No. 2) 2010 [s 4] ‘171 Objects of quarantine ‘The objects of the quarantine for the pest quarantine area are— (a) to prevent the introduction of myrtle rust into the pest quarantine area; and (b) to prevent or control the spread of myrtle rust in the pest quarantine area; and (c) to prevent or control pest infestations of myrtle rust in the pest quarantine area. ‘172 Restriction on introduction ‘(1) A person must not, without an inspector’s approval, introduce into the pest quarantine area— (a) myrtle rust; or (b) a relevant plant grown in or despatched from another State in which myrtle rust has been detected; or (c) an appliance that has been in contact with a relevant plant mentioned in paragraph (b). ‘(2) An inspector may give an approval, with or without conditions, for the introduction of a thing mentioned in subsection (1)(b) or (c) only if the inspector is satisfied the introduction of the thing will not pose a significant risk of spreading myrtle rust in the pest quarantine area. ‘(3) In this section— relevant plant means a plant of the family Myrtaceae. Note — Under the Act, schedule 2— plant means a member of the plant kingdom and includes the seed or seedling of or a part of a plant, whether living or dead and whether attached to a plant but does not include timber in service. Examples of a part of a plant — flower, foliage, fruit, germplasm, pollen, tissue culture’. 2010 SL No. 339 Page 3
