s1 2 s5 Plant Protection Amendment Regulation (No. 2) 2002 No. 42, 2002 1 Short title This regulation may be cited as the Plant Protection Amendment Regulation (No. 2) 2002 . 2 Regulation amended This regulation amends the Plant Protection Regulation 1990. 3 Replacement of pt 5A, hdg Part 5A, heading— omit, insert — ‘PART 5A—FIRE ANTS ’. 4 Amendment of s 18P (General obligation of land owner in pest quarantine area) Section 18P, heading— omit, insert — ‘18P Obligation of land owner to allow surveillance ’. 5 Insertion of new s 18PA After section 18P— insert — ‘18PA Preventative treatment of land, plants and other things ‘If an inspector considers it necessary to prevent the fire ant spreading in the pest quarantine area, an owner of land must allow the inspector to treat— (a) the land; or (b) a plant, or other thing the inspector reasonably believes may spread the fire ant, on the land.’.

s6 3 s6 Plant Protection Amendment Regulation (No. 2) 2002 No. 42, 2002 6 Replacement of s 18R (Treatment of land, plants and other things) Section 18R— omit, insert — ‘18R Treatment of infested land, plants and other things ‘An owner of land infested with the fire ant must allow an inspector to treat— (a) the land; or (b) a plant, or other thing infested with the fire ant, on the land.’.
