s1 3 s6 Plant Protection Amendment Regulation (No. 1) 2007 No. 19, 2007 1 Short title This regulation may be cited as the Plant Protection Amendment Regulation (No. 1) 2007 . Editor’s notes 1 See the note to the Plant Protection (Mango Leaf Gall Midge) Notice 2006 , section 1, about the expiry of the notice on the commencement of a regulation under section 4(3)(a) of the Act. 2 See the note to the Plant Protection (Mango Leaf Gall Midge) Quarantine Notice 2006 , section 1, about the expiry of the notice on the commencement of a regulation under section 11(1) of the Act. 2 Regulation amended This regulation amends the Plant Protection Regulation 2002. 3 Amendment of ch 3, pt 6, hdg Chapter 3, part 6, heading, ‘Red-banded’— omit, insert— Red banded ’. 4 Amendment of s 90 (Restriction on introducing Mediterranean fruit fly host plant) Section 90(1), ‘50km’— omit, insert— ‘15km’. 5 Omission of ch 3, pts 12 and 14 Chapter 3, parts 12 and 14— omit. 6 Insertion of new s 132 Chapter 3, part 13— insert—
s7 4 s9 Plant Protection Amendment Regulation (No. 1) 2007 No. 19, 2007 ‘132 Treatment of targeted pest or infested plant ‘(1) This section applies to a person moving a targeted pest or a plant infested with a targeted pest within or out of the pest quarantine area. ‘(2) If an inspector directs the person to treat the targeted pest or infested plant, the person must carry out the treatment in the way directed by the inspector. ‘(3) If an inspector directs the person to allow the inspector to treat the targeted pest or infested plant, the person must not refuse to allow the inspector to carry out the treatment. ‘(4) When making the direction, the inspector must give the person an offence warning.’. 7 Amendment of s 136 (Definitions for pt 15) Section 136, definitions canker direction , consumption movement, export movement , interstate produce number , non-quarantined area , prescribed conditions , prescribed matters , prescribed way , each occurrence, treatment method A , treatment method A product , treatment method B , treatment method C , treatment method D , treatment method D product and treatment method E omit. 8 Amendment of s 138 (Objects of quarantine) Section 138(d)— omit. 9 Amendment of s 139 (Restrictions on movement into, within or out of pest quarantine area) (1) Section 139(2) and (3)— omit, insert— ‘(2) Subsection (1) does not apply to a person moving a host plant, appliance or other thing, if the person— (a) has an inspector’s approval to move the host plant, appliance or other thing; and

(3) Section 139(4)— renumber as section 139(3). 10 Omission of ss 140 and 141 Sections 140 and 141— omit. 11 Amendment of s 147 (Restriction on planting particular plants) (1) Section 147(1)— omit, insert— ‘(1) A person must not— (a) plant a relevant host plant on land within the pest quarantine area before 1 July 2007; or (b) without an inspector’s approval, plant on land within the pest quarantine area— (i) a native citrus plant or non-citrus plant; or (ii) a relevant host plant on or after 1 July 2007.’. Editor’s note The areas mentioned in paragraphs (a), (b) and (c) approximate respectively to the Erub, Ugar and Mer council areas declared under the Community Services (Torres Strait) Regulation 1998 , schedule 1A. ‘167 Object of quarantine ‘The object of the quarantine for a pest quarantine area is to prevent mango leaf gall midge being brought out of the pest quarantine area. ‘168 Restrictions on movement out of pest quarantine area ‘(1) A person must not, without an inspector’s approval, move a mango leaf gall midge, or a mango plant, out of a pest quarantine area. ‘(2) An inspector may give an approval under subsection (1) only if the inspector is satisfied the movement of the mango leaf gall midge or mango plant will not pose a significant risk of spreading mango leaf gall midge in Queensland.’. 15 Replacement of ch 4 hdg and ch 4, pt 1 hdg Chapter 4, heading and chapter 4, part 1, heading— omit, insert—
