s1 2 s4 Plant Protection Amendment Regulation (No. 1) 2005 No. 87, 2005 1 Short title This regulation may be cited as the Plant Protection Amendment Regulation (No. 1) 2005 . 2 Regulation amended This regulation amends the Plant Protection Regulation 2002. 3 Amendment of s 131E (Definitions for pt 17B) (1) Section 131E— insert canker bacterium means Xanthomonas axonopodis pv. citri (Hasse) Vauterin.’. (2) Section 131E, definition canker , after ‘Disorders’ ’— insert ‘, caused by the canker bacterium’. 4 Insertion of new pt 17B, div 7 Part 17B— insert ‘Division 7 Requirements for host plants in Selma Road area ‘131X Definition for div 7 ‘In this division— Selma Road area means the area, within the pest quarantine area, consisting of the following lots— (a) lot 1 on RP 898323; (b) lot 15 on CP 908882; (c) lot 3 on RP 842953; (d) lot 4 on RP 842963; (e) lot 5 on RP 842963;
s4 3 s4 Plant Protection Amendment Regulation (No. 1) 2005 No. 87, 2005 (f) lot 3 on RP 898323; (g) lot 179 on plan DSN 979. ‘131Y Restriction on movement of host plants ‘(1) A person must not move a host plant into or out of the Selma Road area. ‘(2) Subsection (1) does not apply to a person moving a part of a host plant the subject of an export movement if the person— (a) has an inspector’s approval for the movement; and (b) if the inspector has imposed conditions on the approval—complies with the conditions of the approval. ‘(3) This section applies despite section 131H. ‘(4) In this section— export movement means any of the following— (a) the movement of the fruit of a host plant, and any part of the host plant attached to the fruit, into the Selma Road area for packing the fruit for export; (b) the movement of the fruit of a host plant out of the Selma Road area for export. ‘131Z Destruction of host plants within Selma Road area ‘(1) The chief executive must ensure an inspector is nominated and directed to destroy all infested host plants that are on land within the Selma Road area. ‘(2) The inspector nominated under subsection (1) may destroy all infested host plants that are on land within the Selma Road area. ‘(3) Subsection (4) is a direct instruction for section 11B 1 of the Act. ‘(4) Urgent and immediate action must be taken to destroy all infested host plants that are on land within the Selma Road area. 1 Section 11B (Review of particular decisions and actions) of the Act
