s1 4 Plant Protection Amendment Act 2007 The Parliament of Queensland enacts— s3 No. 9, 2007 1 Short title This Act may be cited as the Plant Protection Amendment Act 2007 . 2 Act amended This Act amends the Plant Protection Act 1989. 3 Amendment of s 11A (Approved plant variety) (1) Section 11A(1)(a), ‘the pest quarantine area’— omit, insert — ‘a pest quarantine area (the relevant quarantine area )’. (2) Section 11A(1)(b), (3), and 8(a), ‘pest quarantine area’— omit, insert — ‘relevant quarantine area’. (3) Section 11A(3), ‘pest to a crop’— omit, insert — ‘pest the subject of the relevant quarantine area (the quarantine area pest ) to a crop’. (4) Section 11A(4), ‘subsection (3)’— omit, insert — ‘subsection (1)’. (5) Section 11A(4)(a), (b) and (c)(i) and (iii), ‘pest’— omit, insert — ‘quarantine area pest’. (6) Section 11A— insert—

s3 5 s3 Plant Protection Amendment Act 2007 No. 9, 2007 ‘(4A) Subsections (3) and (4), other than the requirement to consider relevant circumstances under subsection (4)(c), do not apply if the chief executive is satisfied it is no longer possible to prevent or control the spread of the quarantine area pest in Queensland. ‘(4B) If all of Queensland is the subject of a pest quarantine area for any pest, an approved plant declaration may be made even if the planting or cultivating of an approved plant variety under the declaration may spread the pest to a crop plant within the relevant quarantine area.’. © State of Queensland 2007
