PLANT DISEASES AMENDMENT REGULATIONS (NO. 9) 1993
Made by His Excellency the Governor in Executive Council.
Citation
1. These regulations may be cited as the Plant Diseases Amendment
Regulations (No. 9) 1993.
Principal regulations
2. In these regulations the Plant Diseases Regulations 1989* are referred to
as the principal regulations.

Regulation 17 repealed and a regulation substituted
3. Regulation 17 of the principal regulations is repealed and the following
regulation is substituted —
Citrus, Fortunella, Poneirus — Citrus Leaf Miner
17. (1) A person may bring or send into the _part of the State south of 21° South Latitude from the part of the State north of 21° South Latitude, any plant of any of the genera Citrus, Fort unella and Poncirus —
(a) if —
(i) the area in which the plant was grown is declared free of citrus leaf miner by the
Department of Agriculture;(ii) it is accompanied by a statutory declaration by
with subparagraph (I). the grower to the effect that the plant was grown in an area so declared by the Department of Agriculture; and
(iii) it has affixed to it a label bearing the address
of the place where the plant was grown;
or
(b) if the plants are certified as —
(i) free from leaves and flush growth; and
(ii) having —
(I) been treated for citrus leaf miner with a solution of 6 ml of diazinon (80% active ingredient) and 120 ml of white petroleum oil in 10 litres of water; or
(II) come from an approved nursery where the plants were treated in accordance

A consignment from an approved nursery referred to in subregulation (1) (b) (ii) (II) must be accompanied by a declaration made by the occupier of the approved nursery specifying that the plants were treated in accordance with subregulation (1) (b) (ii) (I) no more than 3 days before the plants were consigned.
(3) For the purposes of regulation 16 (1) citrus leaf miner is a specified disease.
Schedule 1 amended
4. Schedule 1 to the principal regulations is amended in Part B —
(a) in clause 4 by deleting paragraph (b) and substituting the
following paragraphs —44
(b) to be from an accredited fruit fly free area; Or
(c)
to be certified as having been treated for fruit fly control at one of the following temperatures —
0°C ± 0.5°C for 14 days; or
1.0°C ± 0.5°C for 16 days; or
1.5°C ± 0.5°C for 18 days.
and
(b) by repealing clause 27 and substituting the following clause — 44
27. Citrus, Fortunella and Poncirus
plants — Citrus Leaf Miner (Phyllocnistis citrella) Plants must —
(a) be certified as grown in an area free from citrus leaf miner and have a label affixed bearing the address of the place where the plant was grown; or
(b) be certified as free from leaves or flush growth.
