Plant Diseases Amendment Regulations

(No. 8) 2003

Made by the Governor in Executive Council.

1.            Citation

These regulations may be cited as the Plant Diseases
Amendment Regulations (No. 8) 2003.

2.            The regulations amended

The amendments in these regulations are to the Plant Diseases
Regulations 1989*.

3.             Schedule 1 amended

(1) Schedule 1 Part A is amended in column 4 of the item relating
to "Lucerne" by inserting before "16, 20" —
" 1,
(2) Schedule 1 Part AA is amended as follows:
(a) by deleting the item relating to "Aquatic fish";
(b) by inserting after the item relating to "Landscaping material" the following item —

(3) Schedule 1 Part B is amended as follows:

(a) in item 1(1) by inserting after the entry beginning

"Lucerne: plants" -

"

Lucerne: seed other than seed from South Australia -

bacterial wilt (Clavibacter (Corynebacterium)

michiganense subsp. insidiosum).

(b) in item 15 by deleting "Sugar cane plants or parts of

Australia (above 26° South) from other parts of

plants are prohibited from entering the North of Western inserting instead -

"

Sugar cane plants or parts of plants are prohibited from entering Western Australia from other parts of Australia without the prior approval of the Director General.

(c) in item 20 by deleting "To be certified that the seed was

grown in an area where bacterial wilt is not known to

exist." and inserting instead -

From South Australia, to be certified by an officer of the Department of Primary Industries and Resources South Australia, as being grown on a property -

(a)

that has been inspected and found free from bacterial wilt; or

(b)

that has been PCR (polymerase chain reaction) tested and found free from bacterial wilt.

(d) in item 26(4) and (5) by deleting "Industry and

Resources of that State" and inserting instead -

" Industries and Resources South Australia ";

(e) in item 35(2) by deleting "South Australian Department

of Agriculture" and inserting instead -

Department of Primary Industries and Resources

South Australia

(1) in item 42 by inserting after "animal skins/coats" -

live fish ";

(g) in item 42 by deleting "subject to regulation 20(2), and";
(h) in item 43 by deleting "Aquatic fish" and inserting instead -

4.            Schedule 5 amended

Schedule 5 is amended as follows:

(a) by deleting the 5 items relating to "Raphiolepis";
(b) by deleting the item relating to "Rhaphiolepsis";

(c)

by inserting in the appropriate alphabetical positions the following items —
