PLANT DISEASES AMENDMENT REGULATIONS (NO. 4) 1993

Made by His Excellency the Governor in Executive Council.

Citation

1. These regulations may be cited as the Plant Diseases Amendment

Regulations (No. 4) 1993.

Principal regulations

2. In these regulations the Plant Diseases Regulations 1989* are referred to

as the principal regulations.

Regulation 4 amended

3. Regulation 4 of the principal regulations is amended by deleting "Penalty: $1 000." at the foot of subregulation (2) and substituting the following —

" Penalty: $5 000.

Regulation 6 amended

4. Regulation 6 of the principal regulations is amended by deleting "Penalty: $1 000." at the foot of subregulation (2) and substituting the following —

" Penalty: $5 000.

Regulation 7 amended

" Penalty: $5 000.

5. Regulation 7 of the principal regulations is amended by deleting "Penalty: $1 000." at the foot of subregulation (2) and substituting the following —

" Penalty: $5 000.

Regulation 8 amended

6. Regulation 8 of the principal regulations is amended by deleting "Penalty: $1 000." at the foot of subregulation (1) and substituting the following —

" Penalty: $5 000.

Regulation 11 amended

7. Regulation 11 of the principal regulations is amended by deleting "Penalty: $1 000." at the foot of subregulation (3) and substituting the following —

Regulation 12 amended

8.   Regulation 12 of the principal regulations is amended by deleting

"Penalty: $1 000." at the foot of the regulation and substituting the

following —

" Penalty: $5 000.

Regulation 13 amended

9. Regulation 13 of the principal regulations is amended by deleting "Penalty: $1 000." at the foot of the regulation and substituting the following —

" Penalty: $5 000.

Regulation 14 repealed and a regulation substituted

10. Regulation 14 of the principal regulations is repealed and the following

regulation substituted —

Movement under quarantine notice

14. (1) A notice under section 23 of the Act, directing that a

conveyance, vessel or consignment be taken, under quarantine, to
a specified place shall be in the form of Form 2 Schedule 3.

Where a notice is issued to a person under section 23 of the Act requiring that person to take a conveyance, vessel or consignment under quarantine, to a specified place, the person shall take the conveyance, vessel or consignment directly to the specified place, in toto.

(2)

Penalty: $5 000.

(3) Where a conveyance, vessel or consignment is detained

at a place pursuant to section 23 of the Act, a person shall not

remove it from that place without the permission of an inspector.
