PLANT DISEASES AMENDMENT REGULATIONS 1997

Made by His Excellency the Governor in Executive Council.

Citation

1. These regulations may be cited as the Plant Diseases Amendment

4 March 19971 GOVERNMENT GAZETTE, WA 1353

Regulation 17 repealed

3.     Regulation 17 of the principal regulations is repealed.

Schedule 1 amended

4.     (1) Schedule 1 to the principal regulations is amended in Part A by

inserting in the appropriate alphabetical positions the following items -

(2) Schedule 1 to the principal regulations is further amended in

Part A -

(a) in the item relating to "Citrus" in columns 2 and 3 by deleting

(b)

in the item relating to "Seed" in column 1 by inserting after "also" the following -

Chickpea, ";and

in the item relating to "Sorghum" in column 4 by inserting after

(c) "23" the following -

,23A ".

(3) Schedule 1 to the principal regulations is amended in Part B -

(a) in item 1 in the entry relating to "Sorghum" by inserting after "(Contarinia sorghicola)" the following -

Ergot (Claviceps spp.) ";

(b) after item 4 (a) (i) by deleting "or";
(c) after item 4 (a) (ii) by inserting "or" and the following
subparagraph -

(iii)    having been fumigated with methyl bromide for

2 hours at one of the following rates -

24 g/m3 at 260 - 31.9°C 32 g/m3 at 210 - 25.9°C 40 g/m3 at 150 - 20.9°C

48 g/m3 at 100 - 14.9°C;

(d) by inserting after item 23 the following item -

"

23A. Sorghum seed - Ergot (Claviceps spp.)

(1) Seed for sowing is to be -

(a) certified as treated in the following manner -

immersed for 1 minute in a 10% salt

(i)       (sodium chloride) solution;

(ii)     all floating material removed, examined

by a plant pathologist and found to be

free from Ergot (Claviceps spp.); and

(iii)    dipped in a solution of 2% available chlorine for 5 minutes or dusted in

Thiram 80% at the rate of 200 g/100 kg of seed;

(b) certified as -

(i)

harvested before 1 December 1994 and kept separate from any seed harvested after that date from an infected area; and

(ii) sampled at the rate of 1 kg(100 kg (or
treated in the following manner - part of 100 kg) of seed with each sample
(I) salt (sodium chloride) solution; and

immersed for 1 minute in a 10%

(II)

all floating material removed, examined by a plant pathologist and found to be free from Ergot (Claviceps spp.);

or

(c) certified as -

(i)

grown more than 50 km from an outbreak of Ergot (Claviceps spp.);

(ii)

sampled at the rate of 1 kg/100 kg (or treated in the following manner - part of 100 kg) of seed with each sample

(I) immersed for 1 minute in a 10% salt (sodium chloride) solution; and

(II) all floating material removed, examined by a plant pathologist
and found to be free from Ergot
(Claviceps spp.);
and

(iii) dipped in a solution of 2% available chlorine for 5 minutes or dusted in Thiram 80% at the rate of 200 g/100 kg of seed.

(2) Seed for use other than sowing is to be certified as sampled at the rate of 1 kg/tonne (or part of a tonne) of seed with each sample treated in the following manner —

(a) immersed for 1 minute in a 10% salt (sodium

chloride) solution; and

(b) all floating material removed, examined by a

plant pathologist and found to be free from

Ergot (Claviceps spp.). 99.
(e) by deleting item 27; and
(f) by inserting after item 52 the following items —

53. Plants and cut flowers (except corms free from trash) of Babiana (baboon flower, baboon root), Crocos, Crocosmia

aurea (Planchon), Gladiolus, Tritonia and Watsonia — Gladiolus Rust (Uromyces transversalis)

To be certified by an officer of the Department of Agriculture (or its equivalent) in the exporting State, Territory or country as grown in an area where the disease Gladiolus Rust has not been detected.

54. Chickpea: Plants and seed — Asochyta rabiei

Entry of plants and seed into Western Australia from another State or a Territory is prohibited except with the prior approval of the Director General.

5.     Schedule 5 to the principal regulations is amended by inserting in the
