AN ACT to amend the Plant Diseases Act, 1914-1958.

[Assented to 24th December, 1958.]

BE it enacted by the Queen's Most ExcellentMajesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

1. (1) This Act may be cited as the Plant	Short title
and citation.

Diseases Act Amendment Act (No. 2), 1958.

(2) In this Act the Plant Diseases Act, 1914-1958, =M.

is referred to as the principal Act.

(3) The principal Act as amended by this Act

may be cited as the Plant Diseases Act, 1914-1958.

Commence-

ment. 2. This Act shall come into operation on a day to

be fixed by proclamation.

amended

added by	(a)	by adding before the word, "period" in line

1946, s. 2,	six of paragraph (a), the word, "minimum";
and am. by NO. 11 of
(b)	by adding after the word, "notice" being the
1949, No. 3 of 1950, and No. 57 of 1954.	last word in paragraph (a), the passage, ", and a Committee so named shall continue after the expiration of that period so to administer the scheme and so to control and prevent the fruit fly pest in the district until the holding of a poll requested by not less than ten per centum of the number of persons who would, if a poll were held, be entitled to vote";
(c)	by substituting for the words, "one shilling" in lines four and five of paragraph (B) of item (I) of subparagraph (v) of paragraph (d), the words, "two shillings"; and

added by No.	(d) by amending paragraph (C) of item (1) of subparagraph (v) of paragraph (d) by substituting for the word, "five" in line one, the word, "seven"; by substituting for the words, "three pence" in line three, the word, "sixpence"; and by substituting for the words, "one shilling and sixpence" in line four, the words, "three shillings".

S. 39 am. 4. Section thirty-nine of the principal Act is amended by substituting for the passage, "at two shillings and that other registration fees may be graded from two shillings and sixpence upwards, according to area" in lines seven, eight, nine and ten of paragraph (c) of subsection (2), the following-

(i)    for an orchard in which less than twenty- five fruit trees or fruit vines are planted— at two shillings;

(ii)    for a nursery of any area—at two shillings,

(iii)    for an orchard, or for any part of an orchard, in the area of which are planted not less than twenty-five fruit trees or fruit vines— at two shillings if and while the fruit trees and fruit vines are less than four years old;

(iv)    for an orchard in which are planted fruit trees or fruit vines to a number of more than twenty-four and of less than one hundred—at five shillings; and

(v)    for an orchard of not less than one acre planted with fruit trees or fruit vines—at five shillings for each acre, and at five shillings for each additional part of an acre, of the orchard.
