AN ACT to amend the Plant Diseases Act,

1914-1952.

[Assented to 23rd December, 1954.]

BE it enacted by the Queen's Most ExcellentMajesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

1. (1) This Act may be cited as the Plant Diseases

Act Amendment Act, 1954.

is referred to in this Act as the principal Act.

s. 3.

(a)

by substituting for the words, "six shillings per one hundred plants" in lines three and four of subitem (A) of item (I) of subpara- graph (v) the words, "eight shillings per one hundred plants";

(b)

by substituting for the words, "less than one hundred plants" in lines one and two of subitem (B) of item (I) of subparagraph (v) the words, "less than seven plants", and by deleting the words "either" in line two and "one and one-half pence per plant or" in lines three and four and "whichever of those charges shall be the greater" in lines nine, ten and eleven;

(c)

by adding after the word "greater;" being the last word in subitem (B) of item (I) of subparagraph (v) the word, "or" and the following subitem:—

(C)

of more than five but less than one hundred plants, not exceed, either a charge of three pence per plant, or one shilling and sixpence for each attendance at the orchard, by any person by or on behalf of the Com- mittee for the purpose of baiting the plants, whichever of those charges shall be the greater;

(d)

by adding after the word, "Chairman" being the last word in subparagraph (vi) the words, "and an averment in a complaint so made that an orchard is situated in the district in respect of which the Committee is appointed under paragraph (a) of this

section, is prima facie proof to that effect".
