AN ACT to amend the Plant Diseases Aet, 1914-1946.

[Assented to 1st December, 1947 .]

BE it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legis- lative Council and Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows :—

This Act may be cited as the Plant Diseases Act Amendment Act, 1947, and shall be read as one with the

Short title.

Plant Diseases Act, 1914-1939 (Act No. 23 of 1914 as reprinted pursuant to the Amendments Incorporation Act, 1938, in Volume 2 of the Reprinted Acts of the Par- liament of Western Australia, 1943, and amended by No. 25 of 1946), hereinafter referred to as the principal Act.

The principal Act as amended by this Act may be cited as the Plant Diseases Act, 1914-1947.

3. The principal Act is amended by inserting after Yra.,shea°17

section six a section as follows :-

6A. An inspector may detain any plant in respect

of which fees have become payable for any inspection

pursuant to the provisions of sections five and six of

this Act until payment of those fees, and failing payment thereof within a period of one month from the time when the payment became due may dispose of the plant by sale or otherwise: Provided that in the case of sale the proceeds shall be appropriated in payment or part payment of the amount due for fees and any balance remaining after payment in full of the fees shall be transmitted to the person entitled thereto.
