Planning and Development Act 2007

1. Name of regulation

   This regulation is the Planning and Development Amendment Regulation 2013 (No 1).

2. Commencement

   This regulation commences on the day after its notification day.

   NoteThe naming and commencement provisions automatically commence on the notification day (see Legislation Act, s 75 (1)).

3. Legislation amended

   This regulation amends the Planning and Development Regulation 2008.

4. Schedule 1, section 1.1, new definition of party wall

   insert

   party wall—see the Common Boundaries Act 1981, section 27.

5. Schedule 1, section 1.100 (3), new definition of single dwelling

   insert

   single dwelling does not include a dwelling that has a party wall.

6. Schedule 1, new section 1.100B (2)

   after the note, insert

   (2)In this section:

   single dwelling does not include a dwelling that has a party wall.

7. Dictionary, new definition of party wall

   insert

   party wall, for schedule 1 (Exemptions from requirement for development approval)—see schedule 1, section 1.1.
