  1. Name of regulation

    This regulation is the Planning and Development Amendment Regulation 2011 (No 2).

  2. Commencement

    This regulation commences on the day after its notification day.

    NoteThe naming and commencement provisions automatically commence on the notification day (see Legislation Act, s 75 (1)).

  3. Legislation amended

    This regulation amends the Planning and Development Regulation2008.

  4. Section 100, new definition of retirement complex

    insert

    retirement complex—see section 170A (2).

  5. Section 100, definition of supportive accommodation

    substitute

    supportive accommodation means any of the following:

    (a)a retirement complex;

    (b)residential care accommodation within the meaning of the territory plan (13 Definitions);

    (c)a retirement village within the meaning of the territory plan (13 Definitions);

    (d)supportive housing within the meaning of the territory plan (13 Definitions).

  6. Section 170A (2), definition of retirement complex

    substitute

    retirement complex means premises used for

    (a)permanent residential accommodation for people 55 years old or older, in self-care units; and

    (b)one or more of the following:

    (i)a hostel;

    (ii)a nursing home.

    NoteSelf-care units that are part of a retirement complex may also be within the meaning of ‘retirement village’ in the territory plan (13 Definitions).

  7. Dictionary, new definition of retirement complex

    insert

    retirement complex—for part 5.1 (Direct sale of leases)—see section 100.
