HIS HONOUR:   I heard this matter on 23 November 2020 in Melbourne and I have determined that the plaintiff’s application should be granted.  I publish my reasons.

The orders of the Court are as follows:

1.The plaintiff is granted an extension of time within which to commence this proceeding.

2.The decision of the defendant’s delegate of 6 August 2019 to refuse to grant the plaintiff a protection visa is quashed.

3.The defendant determine the plaintiff’s application for a protection visa according to law.

4.        The defendant pay the plaintiff’s costs of the application.

I publish those orders.

The Court will now adjourn.
