1      Name of Plan

This Plan is Pittwater Local Environmental Plan 2014 (Amendment No 1).

2      Commencement

This Plan commences on the day on which Pittwater Local Environmental Plan 2014 commences and is required to be published on the NSW legislation website.

3      Land to which Plan applies

(1)

This Plan applies to all of the land to which Pittwater Local Environmental Plan

2014 applies.

(2)

To the extent that this Plan rezones land, it applies to land at 120–122 Mona Vale Road, Warriewood being part of Lot 1, DP 383009 and part of Lots 3, 4 and 5, DP 124602.

4      Maps

Each map adopted by Pittwater Local Environmental Plan 2014 that is specified in Column 1 of the following table is declared by this Plan to be amended or replaced, as the case requires, by the map specified opposite in Column 2 of the table as approved by the Minister on the making of this Plan:

Amendment of Pittwater Local Environmental

Plan 2014

Clause 6.2

Insert after clause 6.1:

6.2

Development requiring the preparation of a development control plan

(1)

The objective of this clause is to ensure that development on certain land

occurs in accordance with a site-specific development control plan.

(2)

Development consent must not be granted for development on land identified as “Clause 6.2” on the Urban Release Area Map unless a development control plan that provides for the matters specified in subclause (3) has been prepared for the land.

(3)

The development control plan must provide for the following:

(a)

a staging plan for the timely and efficient release of urban land making provision for necessary infrastructure and sequencing, including the final design and construction of the required road access,

(b)

an overall landscaping strategy for the protection and enhancement of visually prominent locations and for other matters, and detailed landscaping requirements for both the public and private domain,

(c)

stormwater and water quality management controls,

(d)

amelioration of natural and environmental hazards, including bush-fire, flooding and site contamination and, in relation to natural hazards, the safe occupation of and the evacuation from any land so affected,

(e)

assessment of the biodiversity values on the site and likely impacts and mitigation measures,

(f)

preparation of an Aboriginal Cultural Heritage Assessment (being a written report detailing the results of the assessment and recommendations for actions to be taken before, during and after an activity to manage and protect Aboriginal objects and declared Aboriginal places identified by the investigation and assessment),

(g)

detailed urban design controls.
