An Act for the construction of a Tramroad from the Redfern Railway Terminus to the Semi- Circular Quay. [30th April, 1861.]

2. A Tramroad for conveying passengers and their luggage and

of t h e S o u t h e r n Ra i lway along the cent re of P i t t - s t ree t Sydney or as nea r t he re to as convenient ly can be and a poin t or po in ts on t he Semi-Circular Q u a y in Sydney Cove to be fixed by t h e Governor with t h e advice of t h e Execu t ive Council shall be cons t ruc ted and com ple ted as soon as convenient ly m a y be Provided t h a t t h e gauge of t h e said T ramroad shall not exceed four feet e ight inches and one- half inch a n d t h a t t h e rai ls of t h e said T ramroad shal l in every p a r t

3. The said Commissioner of Ra i lways shall be charged wi th

| all such powers a n d author i t ies created by t h e A c t | twenty-second |
Victor ia n u m b e r n ine t een as a r e necessary for fully ca r ry ing in to effect t he purposes of th i s Ac t and shal l be subject to all t he l ike rules regula t ions a n d responsibil i t ies in re la t ion t he re to as he is subject to in re la t ion to t he duties imposed u p o n h i m by t h e said last reci ted Act so far as t h e same are applicable to such purposes A n d except as here in expressly enacted all o ther t h e provisions of t h e same A c t appl icable to t h e cons t ruc t ion complet ion m a n a g e m e n t ma in tenance conduct work ing and regula t ion of t he l ines of Ra i l road to be con s t ruc ted the reunder shall so far as appl icable as aforesaid apply to t he cons t ruc t ion complet ion m a n a g e m e n t ma in tenance conduct work ing a n d regula t ion of the T ramroad to be cons t ruc ted unde r th is Act .
4. The Commissioner for the purposes of th i s Ac t shall have all necessary r igh t s of ingress and regress in to and over t h e surface of t he l and over which t h e said T ramroad shall pass as is requi red for t he cons t ruc t ion repa i r complet ion and use thereof Provided tha t no th ing he re in conta ined shall impa i r or be he ld to impai r t h e lawful au thor i ty of t he Munic ipa l Council of Sydney or of any company or person to m a k e al l en t rances necessary for t h e cons t ruc t ion main te -
nance a n d preserva t ion of Gas Works W a t e r W o r k s Sewerage W o r k s and other works lawfully cons t ruc ted unde r g round in t h e aforesaid street .
| 5. The said Commissioner shall m a i n t a i n in perfect | order a n d |
repa i r t h e said T ramroad a n d t h e m e t a l of t h e s t reet be tween t h e ra i l s of t h e said Tramroad and for t h e space of one foot on e i ther side of such rai ls level w i t h t h e surface a n d shal l immedia te ly in case any
