Pignat, In the matter of an application for leave to issue a proceeding

Rodger George Pignat and Sharon Beth Pignat applied to the High Court of Australia for leave to issue a proceeding. This application followed a direction by Justice Crennan on 25 February 2013, requiring the Registrar to refuse to issue or file the writ of summons without the leave of a Justice. The applicants sought this leave on 19 March 2013.

The central legal issue before the court was whether to grant the applicants leave to issue their proceeding, given the prior direction from Justice Crennan. This required the presiding Justice to consider the merits of the proposed proceeding and whether it met the threshold for leave to be granted.
