No. 42 of 1969.

AN ACT to amend the Pig Industry Compensation

Act, 1942-1965.

[Assented to 21st May, 1969.]

BE it enacted by the Queen's Most ExcellentMajesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:--

Short title

and citation.

1. (1) This Act may be cited as the Pig Industry

Compensation Act Amendment Act, 1969.

2. Section three of the principal Act is amended— 8.3 amended

(a)

as to the interpretation "Approved person", by substituting for the word, "Minister", in line two, the words, "Chief Veterinary Surgeon"; and

(b)

by substituting for the interpretation, "Disease" the following interpretation

"Disease" means tuberculosis, swine erysipelas or para-typhoid, and any other enzootic disease, within the meaning of the Stock Diseases (Regulations) Act, 1968, of swine that the Governor may from time to time by proclamation declare to be a disease for the purposes of this Act; and the term "diseased" has a corres- ponding meaning; .

Section six of the principal Act is amended— 8.6 amended. (b) as to paragraph (c)—

(i)  by deleting the passage, "swine fever,", in line four;

(ii)  by adding after the word, "para- typhoid", in lines four and five, the words, "or any other disease that may be prescribed";

and

(c) as to paragraph (d), by substituting for the

words, "other authorised", in line six, the

words, "an approved".

4. Section seven of the principal Act is 5.7 amended.

(a) as to paragraph (b) of subsection (1),-

(i)

by deleting the passage, "swine

fever,", in line four; and

(ii) by adding after the word, "paraty- phoid" in line five, the words, "or any other disease that may be prescribed";

and

(b)

by repealing subsection (2) and re- enacting it as follows

(2) For the purposes of this Act, the market value of a pig shall not exceed an amount from time to time recom- mended by the Minister and approved by the Governor. .

5. Section eight of the principal Act is

amended

(a)

by repealing subsection (1) and re-enacting it as follows

(1) The value of a pig destroyed because it is suffering from, or is suspected to be suffering from, disease shall be determined by the Chief Veterinary Surgeon or an approved person. ;

(b) as to subsection (2),-

(i)  by deleting the passage, "swine fever," in line three; and

(ii)   by adding after the word, "para- typhoid", in line four, the words, "or any other disease that may be prescribed"; and

(c) as to subsection (3),-

(i)  by deleting the passage, "swine fever," in line two; and

(ii)  by adding after the word, "para- typhoid", in line two, the words, "or any other disease that may be prescribed".

6.Section nine of the principal Act is amended— 6" anlended• (a) as to subsection (2),-

(i)  by deleting the passage, "swine fever,", in line six; and

(ii)  by adding after the word, "para- typhoid", in lines six and seven, the words, "or any other disease that may be prescribed";

(b) as to subsection (3),-

(i)  by deleting the passage, "swine fever," in line five of paragraph (a); and

(ii)  by adding after the word, "para- typhoid", in line five of paragraph (a) the words, "or any other disease that may be prescribed"; and

as to subsection (4), by substituting for

(c)

paragraph (c) the following paragraph

(c)

in respect of a pig introduced into the State and that is, within one month after being so introduced, ordered to be destroyed because it is suffering, or is suspected to be suffering from disease, unless the Chief Veterinary Surgeon is satisfied that the pig became diseased after being so introduced or unless it is found on post mortem examination to be free from disease. .

7. Section thirteen of the principal Act is

amended.

amended by repealing subsection (3) and re-

enacting it, as follows

(3) The Fund shall, subject to this Act, be

applied to

(a)

the payment, pursuant to this Act, of claims for compensation;

(b)

the payment of the costs of the pro- vision of, or the promotion and encouragement of, scientific research for the improvement of pig production; and

(c)

any other purpose that, in the opinion of the Minister, will promote and encourage the pig industry. .

5.21 emended. 8. Section twenty-one of the principal Act is

amended by deleting the words, "or dying of swine

fever", in line seven of paragraph (b).
