HER HONOUR:   Ms Piepkorn has presented a summons and Statement of Claim which name the State of South Australia as defendant.  On 9 September 1999, Justice Hayne directed, pursuant to Order 58, rule 4(3) of the High Court Rules that that process not issue without the leave of a Justice.  Ms Piepkorn now seeks that leave.

The Statement of Claim does not identify a cause of action against the State of South Australia or any other basis upon which Ms Piepkorn might be entitled to relief.  Accordingly, her application for leave to issue a proceeding must be dismissed.  It is ordered accordingly.

The Court will now adjourn.
