( b) Subsection two thereof is repealed and the following subsection is inserted in lieu thereof, namely :- " ( 2. ) ( a) The Commission may require the applicant to furnish to it, within such period as may be specified, all such further information and particulars as it thinks fit, including (but without limit to its powers under this subsection) information and particulars satisfying the Commission that the applicant can, in the event of the Commission determining to grant the application, establish and maintain a picture theatre in accordance with his application. If the applicant fails to furnish any information or particulars required under this subsection within the tainmde spoarstpiecucilfaiersd bfyurtnhisehCeodmbmyisshiiomn, ofariilfs thtoe insaftoirsmfyattiohne Commission as aforesaid, the Commission may, without further proceedings, reject the application, or may hold the application in abeyance until such time as the applicant shall so satisfy the Commission. * 10 G. 6 No. 12 and a:mending Act.
1948. PICTURE THEATRES AND FILMS. Picture Theatres a;nd Films, Etc. , Act. 333 (b) Unless an application is rejected or held in abeyance under paragraph ( a) of this subsection the C G o a m ze m tte isasniodn onshcealiln, abynewnsoptiafpicearticoinrcuplautbinligshiendthien Atrheae to which the application relates, notify the fact that the application has been received by the Commission. Such notice shall be in or to the effect of the prescribed form, contain the prescribed particulars, and appoint a date on or before which objections to the granting of the application may be lodged with the Commission. " ( c) The following subsection is added thereto, namely : - " ( 4. ) ' Where the Commission has by its determina­ tion refused an application in respect of any locality, no further application in respect of that locality shall be made without prior leave from the Commission until the expiration of a period of twelve months from the time of such refusal. " as fol3lo. wSsec: - tion eight of the Principal Act is amended o A f m 8 e n 8 d ment ( a) Paragraph ( i. ) of subsection three thereof is repealed and the following paragraph is inserted in lieu thereof, namely : - " ( i. ) That the picture theatre the subject of the application is not required for the accommodation of the people in the locality which would be served thereby ; " (b) Paragraphs ( iii. ) and ( iv. ) of subsection three thereof are repealed and the following paragraphs are inserted in lieu thereof, namely : - " ( iii. ) That the granting of the application would rweassutlet ; in undue c• ompetition or economic ( iv. ) That the granting of the application would not be in the public interest. " ( c) Subsection eight thereof is amended by inserting before the words " an additional picture theatre " the words " a picture theatre or, as the case may be, " ; and by repealing the words " shall be approved in respect of the grant of a license " and by inserting the words " shall be granted " in lieu of such repealed words.

The Commission may rescind, vary, or otherwise modify such terms and conditions from time to time as to it shall seem just and equitable. Upon the breach of any such term or condition the Commission may cancel the determination, whereupon the determination and any subsisting license granted by the Local Authority in respect of the use as a picture theatre of the subject of the determination shall become­ and be void and of none effect whatsoever. ( 2. ) The period of temporary use authorised by a permit under this section shall be specified in the permit, and the Commission may by endorsement on the permit extend that permit from time to time. ( 3. ) The Commission may grant such permit either unconditionally or subject to such terms and conditions as it deems fit. ( 4.) An exhibitor who holds a permit under this section may exhibit any film in the building, part of a

Picture Theatres and Films, Etc. , Act. 335 building, ground, place, or premises specified m the permit during the period of the temporary use thereof as a picture theatre authorised by the permit if- ( i. ) A subsisting license issued by the Local Authority in respect of such use is in force ( which license the Local Authority is hereby authorjsed to grant for the period specified on the permit and for any extended period or periods specified by endorsement on the permit) ; and (ii.) (Where the permit is issued subject to terms and conditions) he complies in all respects with every such term or condition, but not otherwise. ( 5. ) An exhibitor shall not exhibit any film in the picture theatre, the unfitness of which for use as such was the ground for the issue of a permit under this section, at any time during which that permit authorises the temporary use by him as a picture theatre of some other building, part of a building, enclosure, ground, place, or other premises. ( i. ) Of the completion of the construction of a new theatre to replace the one so destroyed or demolished ; or (ii.) Of the completion of alterations, renovations, repairs, or rebuilding of the theatre rendered unfit for use as such, make a determination authorising that exhibitor to use such new or, as the case may be, such altered, renovated, repaired, or rebuilt theatre as a picture theatre and, in such case, shall cancel the permit granted under section 8A of this Act. ' '
