Picture Theatres and Films Act Repeal and Other Acts Amendment Act 1990, No. 49 915 BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short title and citation . This Act may be cited as the Picture Theatres and Films Act Repeal and Other Acts Amendment Act 1990. 2. Commencement . (1) Subsection (1) of section 3, to the extent it repeals sections 5 to 9A (both inclusive), 17, 18, 19 and 21 of the repealed Act commenced and is taken to have commenced on the 15th April 1990 and is to be given retrospective effect accordingly. (2) Except as provided for by subsection (1), this Act commences on the date on which it is assented to for and on behalf of Her Majesty. 3. Repeal of Picture Theatres and Films Act. Picture Theatres and Films Act of 1946" as amended by the other Acts specified in the Table to subsection (1) is referred to as the repealed Act.
916 Picture Theatres and Films Act Repeal and Other Acts Amendment Act 1990, No. 49 4. Transitional . (1) In this section, a reference to the Commission is a reference to the Picture Theatres and Films Commission constituted under the repealed Act. (2) It is hereby declared- (a) that on and from the 15th April 1990, the Commission ceased to exist and its assets and liabilities became and are the assets and liabilities of the Crown; (b) that notwithstanding the repeal by this Act of the provisions of section 10 to 16 (both inclusive), section 20 and the Schedule of the repealed Act, those provisions continue to apply in relation to a contract within the meaning of the repealed Act entered into before the repeal as if this Act had not been passed. 5. Amendment of 12 Geo. 6 No. 3. (1) The Censorship of Films Act 1947-1988 is amended, in section 4, by omitting the definition "picture theatre" and substituting the following definition:- " "picture theatre" includes any building or part of a building or any enclosure, ground, premises , place or vessel, wherein or whereon a film is exhibited and to which admission is or may be procured by the payment of money, or the giving of other consideration or by token or by any other means as the price or condition of admission;". (2) The Censorship of Films Act 1947-1988 as amended by subsection (1) may be cited as the Censorship of Films Act 1947-1990. 6. Amendment of No. 31 of 1974 . (1) The Films Review Act 1974- 1988 is amended, in section 4, by omitting the definition "Picture theatre" and substituting the following definition:- "picture theatre" includes any building or part of a building or any enclosure, ground, premises , place or vessel, wherein or whereon a film is exhibited and to which admission is or may be procured by the payment of money, or the giving of other consideration or by token or by any other means as the price or condition of admission;". (2) The Films Review Act 1974-1988 as amended by subsection (1) may be cited as the Films Review Act 1974
