132 Quunsfanzr ANNO VICESIMO QUINTO ELIZABETHAE SECUNDAE REGIN AE No. 18 of 1976 An Act to amend the Picture Theatres and Films Act 1946-1974 in certain particulars [ASSENTED TO 15TH APRIL, 1976] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short title and citation . (1) This Act may be cited as the Picture Theatres and Films Act Amendment Act 1976. (2) The Picture Theatres and Films Act 1946-1974 is in this Act referred to as the Principal Act.

Picture Theatres and Films Act Amendment Act 1976, No. 18 133 (3) The Principal Act as amended by this Act may be cited as the Picture Theatres and Films Act 1946-1976. 2. Amendment of s. 3. Section 3 of the Principal Act is amended by- (a) omitting from provision (ii) of the proviso the expression ";" and substituting the expression "."; (b) omitting provision (iii) of the proviso. 3. Amendment of s. 4. Section 4 of the Principal Act is amended by- (a) omitting the definition " Director "; (b) omitting the definition " Minister " and substituting the following definition:- " " Minister "-The Minister for Justice and Attorney-General;"; (c) omitting the definition " Prescribed " and the definition " This Act" and substituting the following definition:- " " Under Secretary "-The Under Secretary, Department of Justice.". 4. Amendment of s. 5. Section 5 of the Principal Act is amended in subsection (2) by, (a) omitting from the first paragraph the words " by Commission in His Majesty' s name " and substituting the words " for a term not exceeding 3 years "; (b) inserting after the first paragraph the following paragraphs:- On and from the date of commencement of the Picture Theatres and Films Act Amendment Act 1976 the Commissions of all members of the Commission shall terminate. A person who immediately before the commencement of the Picture Theatres and Films Act Amendment Act 1976 was a member of the Commission shall be a member of the Commission for a term of 3 years from that date.". 5. Amendment of s. 7. Section 7 of the Principal Act is amended by adding at the end of paragraph (b) of subsection (2) the following subparagraph:- " The applicant shall pay the cost of the notifications published pursuant to this paragraph.". 6. Amendment of s. 9A. Section 9A of the Principal Act is amended by- (a) omitting from the first paragraph the words " place, or other premises " and substituting the words " premises, place or vessel ";

134 Picture Theatres and Films Act Amendment Act 1976, No. 18 (b) omitting from the second paragraph the words " chairman of " and substituting the words " secretary to ". 7. Amendment of s. 20 . Section 20 of the Principal Act is amended by omitting the word " Director " wherever it occurs and substituting in each case the words " Under Secretary ".
