856 ANNO VICESIMO ELIZABETHAE SECUNDAE REGINAE No. 66 of 1971 An Act to Amend The Picture Theatres and Films Acts 1946 to 1961 in certain particulars and for another purpose [ASSENTED TO 16TH DECEMBER, 1971 ] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same , as follows:- 1. Short title and citation . (1) This Act may be cited as the Picture Theatres and Films Act Amendment Act 1971. (2) The Picture Theatres and Films Act of 1946 as subsequently amended is in this Act referred to as the Principal Act. (3) The Principal Act as amended by this Act may be cited as the Picture Theatres and Films Act 1946-1971.
Picture Theatres and Films Act Amendment Act 1971, No. 66 857 2. Commencement of Act. This Act shall come into operation on a date appointed by the Governor by Proclamation published in the Gazette. 3. Amendment of s. 5 . Section 5 of the Principal Act is amended by- (a) in subsection (2), omitting the word " three " and inserting in its stead the word " five "; (b) in subsection (5), omitting the word " two " where it occurs in paragraph (b) and inserting in its stead the word " three "; (c) omitting subsection (9) and inserting in its stead the following subsection:- " (9) Confirmation by Minister . Notwithstanding anything contained in this Act, a determination of the Commission shall be of no force or effect until it is confirmed by the Minister.". 4. Amendment of s. 10 . Section 10 of the Principal Act is amended by omitting subsection (1) and inserting in its stead the following subsection:- " (1) Right of rejection . Notwithstanding anything contained in any contract entered into by an exhibitor, whether before or after the commencement of the Censorship of Films Act AmendmentAct1971, in connexion with the supply to him for exhibition of any films or with the exhibition thereof by him, the exhibitor shall, subject to the provisions of this Part of this Act and without incurring any liability for breach of contract, have the right to reject- (a) up to twenty-five per centum of the total number of films to be supplied under any contract; (b) any restricted exhibition film to be supplied under any contract. The provisions of section 12 of this Act shall not affect the right of an exhibitor to reject a restricted exhibition film under subparagraph (b) of this subsection.". 5. Amendment of s. 13. Section 13 of the Principal Act is amended by inserting after the definition " City picture theatres " the following definition:- Restricted exhibition film "-Film classified under section 17 of the Censorship of Films Act1947-1971 as being for restricted exhibition;". 6. Rectification of defect in Proclamation . The Proclamation of His Excellency the Governor bearing date the twenty-sixth day of March, 1946 and published in the Gazette of the same date shall be read as if the references " The Picture Theatres .and Films Act of 1945 " therein made were " The Picture Theatres and Films Act of 1946 " and the Proclamation shall be construed as always having so read. All acts and things done or 'omitted in purported exercise of any power under The Picture Theatres and Films Act of 1946 and any amendment thereof are hereby made and declared to be lawful at and from the time those acts and things were done or omitted. 7. Amendments relating to currency references . The Principal Act is amended as set forth in the Schedule to this Act.
