s1 3 s6 Physiotherapists Regulation 1965 PHYSIOTHERAPISTS REGULATION 1965 [as amended by all amendments that commenced on or before 7 December 2001] PART 1—PRELIMINARY 1 Short title This regulation may be cited as the Physiotherapists Regulation 1965 . PART 2—THE PHYSIOTHERAPISTS BOARD OF QUEENSLAND 4 Time and place of meetings The board shall meet at such times and places as it may from time to time determine. 5 Adjournment of meeting If at the expiration of half an hour after the time appointed for a meeting, a quorum is not present, the registrar shall postpone the meeting and shall name a time and a day not being more than 2 weeks from the time and day of the meeting so postponed as shall seem to the registrar most suitable. 6 Notice of meeting The registrar shall give due notice in writing to each member of the board, setting forth the place, date and time of each meeting and in the case of a special meeting the business thereof.
s7 4 s8 Physiotherapists Regulation 1965 7 Order of business at ordinary meeting At all meetings of the board the general order of business shall be as follows— (a) the minutes of the meeting next preceding; (b) confirmation or otherwise of same; (c) business arising out of minutes of such meeting, including adjourned business; (d) outward correspondence and consideration of inward correspondence; (e) finance— (i) Treasurer’s financial statement; (ii) production of statements for accounts kept by the board with a financial institution; and (iii) accounts for payment; (iv) any other matters of finance; (f) consideration of applications for certificates of registration as physiotherapists; (g) notices of motion; (h) miscellaneous business; (i) date of next meeting. 8 Convening of special meeting (1) The chairperson may convene a special meeting of the board if 3 members request such meeting, in writing, setting out the business of such meeting. (2) The chairperson shall fix the time, date and place of such special meeting and notify the registrar accordingly. (3) No business shall be transacted at any special meeting except such as is stated in the notice.
s 9 5 s 11 Physiotherapists Regulation 1965 9 Rescission of resolution A resolution passed at a meeting must not be rescinded at a subsequent meeting unless notice of such a motion is given at least 7 days before the meeting. 10 Point of order or procedure The chairperson shall decide any point of order or procedure and the chairperson’s decision shall be final. PART 3—REGISTRATIONS 11 Registration and restoration of registration (1) Applicants for registration as physiotherapists shall apply in the approved form and pay the prescribed fee. (1A) The applicant shall set out the applicant’s qualifications in detail. (2) A certificate of registration in the approved form must be issued to every person on registration as a physiotherapist. (3) A duplicate certificate of registration may be issued by the board on application by the holder of the original certificate supported by a statutory declaration to the effect that the original certificate was lost or destroyed, and upon payment of the prescribed fee. (4) Certificates shall be consecutively numbered and the number of every certificate issued by the board shall be recorded in the register with the name of the recipient. (5) Every physiotherapist shall advise the board of every change of address. (5A) If a communication from the board to a physiotherapist is not acknowledged by the physiotherapist within a period of 3 months from the posting thereof, or within that period the physiotherapist fails to notify the board of the physiotherapist’s change of address, the physiotherapist’s name may be removed from the register, but may be restored upon payment of the prescribed restoration fee.
s 12 6 s 13 Physiotherapists Regulation 1965 (6) Where the name of a physiotherapist has been removed from the register for disciplinary reasons, any application for its restoration shall be made in writing to the registrar and shall be signed by the applicant. (7) Such application shall state the grounds on which the application is made, and shall include the names and addresses of at least 2 persons who are able and willing to identify the applicant and to give evidence of the applicant’s character and employment before and since the removal of the applicant’s name from the register. (8) Such persons shall be justices of the peace, ministers of religion, medical practitioners or physiotherapists. (9) The board may require an applicant to verify by statutory declaration any statement made in the applicant’s application, or to provide any additional information. (10) If the board decides not to restore an applicant’s name to the register, upon payment of the prescribed restoration fee, it shall give the applicant the opportunity, if the applicant so desires, to address the board and to produce further evidence in support of the applicant’s application. PART 4—FEES AND FUNDS 12 Fees The fees payable under the Act are in the schedule. 13 When annual licence fee must be paid (1) A person who is already registered as a physiotherapist at the beginning of a year, or becomes registered in January of a year, must pay the annual licence fee for the year on or before 31 January in the year. (2) A person who is not registered as a physiotherapist in January of a year, but applies to be registered in the year, must pay the annual licence fee for the year with the registration fee. (3) If a person is registered as a physiotherapist in December of a year, the annual licence fee for the following year is waived.
s 14 7 s 14A Physiotherapists Regulation 1965 14 Board’s funds (1) An amount payable to the board must be given to the registrar. (2) The registrar must— (a) deposit the amount in an account kept by the board in accordance with the StatutoryBodiesFinancialArrangementsAct1982 , section 31; 1 and (b) for each board meeting, prepare a statement of all amounts received, and payments made, by the board during the statement period. (3) A payment may be made from the account only— (a) by a cheque signed by the registrar and a board member authorised by the board to sign cheques; or (b) in another way authorised by the board. (4) In this section— “statement period” , for a statement for a board meeting, means the period— (a) starting on the first day of the month in which the previous board meeting was held; and (b) ending on the last day of the month immediately before the month in which the meeting is to be held. 14A Honorary treasurer (1) The board may appoint 1 of its members as the board’s honorary treasurer. (2) If an honorary treasurer is appointed, the honorary treasurer must— (a) at each board meeting, present the statement prepared by the registrar under section 14(2)(b); and (b) ensure all amounts received by the board are deposited in the board’s account; and 1 Statutory Bodies Financial Arrangements Act 1982 , section 31 (General banking powers for day-to-day operations)
s 15 8 s 17 Physiotherapists Regulation 1965 (c) ensure any payment made from the board’s account is in accordance with section 14(3). PART 5—COMMON SEAL 15 Board’s common seal (1) The board shall have a common seal in the name of The Physiotherapists Board of Queensland in such design as it may determine. (2) The seal shall remain in the custody of the registrar and shall be affixed by the registrar to certificates of registration and to such other documents as the board may direct. PART 6—PRESCRIBED QUALIFICATIONS 17 Prescribed qualifications for an interstate or territory applicant For section 16(1)(b) of the Act, the prescribed qualifications for an applicant whose qualifications were obtained in a State or Territory (other than Queensland) are— (a) the applicant holds a degree, diploma or certificate in physiotherapy conferred by a university, college or similar institution and recognised by the registration authority in the State or Territory; and (b) the applicant holds, or is eligible for, full registration (not subject to any limitations or conditions as to additional training or supervision), to practise physiotherapy in the State or Territory; and (c) the applicant has successfully completed the written and clinical examinations specified by the board, unless— (i) the degree, diploma or certificate was conferred during the 3 years immediately before the date of application; or
s 20 9 s 20 Physiotherapists Regulation 1965 (ii) the applicant has completed 1 year of full-time practice in physiotherapy (or the equivalent part-time practice) during the 5 years immediately before the date of application. 20 Prescribed qualification for any other applicant For section 16(1)(b) of the Act, the prescribed qualification for an applicant whose qualifications were not obtained in Australia is the final certificate of the Australian Examining Council for Overseas Physiotherapists.
