Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Photo Card Act 2005.

Explanatory note
The object of this Regulation is to extend the categories of people who are not required to pay a fee for a Photo Card. The concession is extended to holders of New South Wales Seniors Cards and people in New South Wales who receive a carer allowance from the Commonwealth government.

This Regulation is made under the Photo Card Act 2005, including sections 5 (3) and 36 (the general regulation-making power).

Concessions) Regulation 2012

1      Name of Regulation

This Regulation is the Photo Card Amendment (Seniors and Carers Fee
Concessions) Regulation 2012.

2      Commencement

This Regulation commences on the Monday immediately following the day on which the Regulation is published on the NSW legislation website.

3 Amendment of Photo Card Regulation 2005

Clause 4A

Omit the clause. Insert instead:

4A Fee exemptions for certain older persons, pensioners and
carers

The following persons are not required to pay a fee for a Photo Card for themselves (whether it is a new Photo Card or a replacement):

(a) a person who holds a Seniors Card issued by the New South Wales government,
(b) a person who is an eligible pensioner within the meaning of the Motor Vehicles Taxation Act 1988,
(c) a person who lives in New South Wales and who receives a carer allowance under the Social Security Act 1991 of the Commonwealth.
