Photo Card Amendment (Fees) Regulation

His Excellency the Governor, with the advice of the Executive Council, has made the following

Regulation under the Photo Card Act 2005.

Explanatory note
Following recent legislative changes, a person is now able to hold at the same time both a Photo Card and
driver licence. The object of this Regulation is to amend the Photo Card Regulation 2014 to provide for the

following fees payable by an applicant:

(a) for a new 10-year Photo Card:
(i) if the applicant applies for the Photo Card at the same time as applying for the issue of a new

driver licence or the variation, renewal or replacement of the applicant’s existing driver
licence—$5, or

(ii)       if the applicant holds a driver licence, but applies for the Photo Card other than at the time referred to in subparagraph (i)—$14, or

(iii)      if the applicant does not hold a driver licence—$93,

(b) for a new 5-year Photo Card:
(i) if the applicant applies for the Photo Card at the same time as applying for the issue of a new

driver licence or the variation, renewal or replacement of the applicant’s existing driver
licence—$5, or

(ii)       if the applicant holds a driver licence, but applies for the Photo Card other than at the time referred to in subparagraph (i)—$14, or

(iii)      if the applicant does not hold a driver licence—$52.

This Regulation also:

(a) decreases the fee for a replacement Photo Card from $25 to $14, and
(b) makes consequential amendments.

This Regulation is made under the Photo Card Act 2005, including sections 5 (3) and 36 (the general regulation-making power).

1      Name of Regulation

This Regulation is the Photo Card Amendment (Fees) Regulation 2017.

2      Commencement

This Regulation commences on 1 March 2017 and is required to be published on the
NSW legislation website.

[1]      Clause 4

Omit the clause. Insert instead:

4      Fees for Photo Card

The fees prescribed for the issue of a Photo Card are as follows:

(a) for a new 10-year Photo Card:
(i) if the applicant applies for the Photo Card at the same time as applying for the issue of a new driver licence or the variation, renewal or replacement of the applicant’s existing driver licence—$5, or
(ii) if the applicant holds a driver licence, but applies for the Photo Card other than at the time referred to in subparagraph (i)—$14, or
(iii) if the applicant does not hold a driver licence—$93,
(b) for a new 5-year Photo Card:
(i) if the applicant applies for the Photo Card at the same time as applying for the issue of a new driver licence or the variation, renewal or replacement of the applicant’s existing driver licence—$5, or
(ii) if the applicant holds a driver licence, but applies for the Photo Card other than at the time referred to in subparagraph (i)—$14, or
(iii) if the applicant does not hold a driver licence—$52,
(c) for a replacement Photo Card—$14.

Omit clause 7 (d).

[3]      Clause 8 Surrender of Photo Card

Omit “(including for the purpose of having a driver licence issued)” from clause 8 (1).
