AN ACT to amend the Pharmacy and Poisons Act,

1910-1952.

[Assented to 23rd December, 1954.]

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

Short title

and citation.

1. (1) This Act may be cited as the Pharmacy

and Poisons Act Amendment Act, 1954.

(2) In this Act the Pharmacy and Poisons Act,

1910-1952,

(3) The principal Act as amended by this Act may be cited as the Pharmacy and Poisons Act, 1910- 1954.

2. Section forty-four of the principal Act is 24:ndea.

amended by

(a)

deleting the word "or" in line twelve of paragraph (b) of subsection (1);

(b) deleting paragraph (c) of subsection (1); (c) adding after the word "business" in the last

line of paragraph (iv) of the proviso to

subsection (1) the word "and";

(d)

adding after paragraph (iv) of the proviso to subsection (1) the following para- graphs:—

(v)    nothing in this section shall operate to prevent a medical practitioner from supplying or selling any medi- cine, drug or poison to a patient whom he is treating and for the purpose of that treatment, or, where it is not reasonably practicable in the circumstances to obtain any medi- cine, drug or poison at a pharmacy, from supplying or selling the medi- cine, drug or poison to any person; and

(vi)    nothing in this section shall operate to permit the carrying on by a medical practitioner of the business of a pharmaceutical chemist;

(e) substituting for paragraphs (a) and (b) of subsection (2) the words "a pharmaceutical chemist".

3. Section forty-five of the principal Act is "5

deleting the words "or legally qualified medical practitioner" in lines one and two of subsection (1);

(b)

deleting the words "or a legally qualified medical practitioner" in the last line of subsection (1).
