[ASSENTED TO 7TH DECEMBER, 1917.] B E it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legis. lative Council and Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows : - ' Short title 1. This Act may'be cited as "The Pharmacy, Act qf un oand cam· :mencement 7," and shall come into operation on the first day of of Act. January, one thousand nine hundred and eighteen. 2. In this Act, un:less the context otherwise indicates, Interprets- the following terms have the meanings set against them tion. respectively, that is to say,- " Board "-The Pharmacy Board constituted under Board. this Act, and, until the constitution of such Board, the Board having the like powers and constituted under the repealed Act; "By-Iaws"-By-Iaws made under the authority of By-laws. this Act; " Drugs"- Drugs for internal or external use: the Drugs. term includes all articles taken and sold as medicines; "Medical Practitioner"-A person registered as a Medical legally qualified medical practitioner under the practitioner. "Medioal Act of 1867,"* and whose name remains upon the register; " Minister"-The Home Secretary or other Minister Minister. of the Orown for the time being charged with the administration of this Act; " Person" includes a corporation or joint stock Person. company; "Pharmaceutical Ohemist "-A person registered as Pha:ma- a pharmaceutical chemist under the repealed ~ ~ ~ : ~ : t. This Act. holder thereof at the date of application ior registration under this Act to practise as a pharmaceutical chemist in the country in question, and as furnishing a sufficient guarantee of the possession of the requisite knowledge and skill for the efficient practice of a pharmaceutical chemist; " Register"-The registerof pharmaceutical chemists hereinafter mentioned; " Hegistrar" - The registrar elected under this Act: until the election of a registrar under this Act, the term includes the officer perform- ing the like duties under the Board pursuant to the repealed Act; "This Act "-This Act and all By-lMYS and Orders in Council made thereunder. Pharmacy 1Board. 4. There shall be a Board, consisting of seven pharmaceutical chemists, which shall be called "The Pharmacy Board," and shall be constituted in manner following, namely:- Appointed members. (1.) Four of the members of such Board shall be appointed by the Governor in Council, and shall remain in office for three years. On or before the thirty-first day of January, one thousand nine hundred and eighteen, and theI!eafter on or before the thirty-first day of December in every third year, the Governor in Council shall appoint four pharmaceutical chemists to be members of such Board. Elected IDembers. (2.) Three of the members of such Board shall be elected by the pharmaceutical chemists of Queensland in manner prescribed, and shall remain in office for three years. ' An election of members and of the registrar shall be 11eld on such day in Novernber in every third year after the first election as the Board by resolution appoint, and all the elected members and the registrar then in office shall go out of office on the thirty-first day of December next following the date of election. But nothing herein contained shall prevent such memberS', if otherwise qualified, or the registrar from being eligible to be re-elected to be members or registrar, as the (}ase may be, at that or at any future election. Board shall, upon the constitution of the Board under this Act, vest in and be imposed upon and be discharged by the last-mentione4 Board. 5. The names of the first members of the Board and Date of th e Presl' dent and regI.strar thereof sha11 be pablI'Shed'In ocofnBsotiaturdti. on the Gazette, and thereupon such Board shall be deemed to be duly constituted under this Act. 6. Any extraordinary vacancy which at any time Ex~ ra. occurs in the office of member or registrar by removal, ~ : : ~ Zs. death, resignation, or otherwise shall be filled as soon as may be by the appointment or election, as the case may be, of another member or by the election of another registrar; but any member appointed or elected and any registrar elected to fill any vacancy shall hold office so long only as his predecessor would have done had no such -vacancy occurred. 7. At their first meeting held after the constitution President. of the Board in the year one thousand nine hundred and eighteen, or at some adjournment thereof, and thereafter at their first meeting held in J anunry in every year or at :some adjournment thereof, the members present shall elect a member to be the ,President of the Board. 8. The provisions set forth in the Schedule to this Act Prov~ sions shall, in all matters to ~ hich they re~ ate, govern and be ~ = ~ ~ : fi~ ~ S applicable to the proceedmgs and busmess of the Board, and business. and shall be observed. The Board may appoint such officers other than the registrar as the Board think necessary for giving effect to this Act, and may pay to all such officers such salary and allowances as the Board think fit. All such persons shall hold office during the pleasure of the Board. (2.) The Board may pay to the registrar such salary and allowances as the Board think fit. Pe~ sons 10. Subject to this Act, every person, whether male or- be ; : ~ !: ~ ~o female, shall be entitled to be registered as a pharmaceutical . chemist under this Act upon making application in that behalf in the prescribed form, and upon proving to the satisfaction of the Board that such person- (a) Has attained the age of twenty-one years. and is a person of good fame and character; and (b) Is re~istered under' the repealed Act; or (0) Has obtained the prescribed certificate of fitness after the prescribed examination; or (d) Holds a recognised certificate; or (e) During a period of at least five years imme- diately preceding the commencement of this Act has' carried on. in an open shop in Queensland the business of a homeopathic chemist; or (f) Prior to the passing of "The PharmacyAct of 1884."* has served for a period of not less than three vears under written indenture or articles to a registered ('hemist and druggist of Queensland, and who since that date has been engaged in the business of a pharmaceutical. chemist. Such person may thereupon appeal to the Supreme Court, and such appeal shall be in the nature of a. rehearing. Annual 12. Pharmacy Act. failing to pay such license fee shall cease to be registered as such; but the Board may at any time restore to the register the name of any pharmaceutical chemist failing to make such payment on receiving- all arrears and pay~ ment of the prescribed restoration fee. 13.' (1.) The Board shall, from time to time, hold ~ xamina­ examinations of persons desirous of qualifying tbemselves tlOns. to be registered as pharmaceut.ical chemists, and shall grant certificates of fitness to persons who have passed all the. examinations and fulfilled all the conditions prescribed. (2.) No person shall be admitted to the final qualifying ~xamination unless he has attained the age of twenty-one years and has fulfilled all the conditions prescribed. (3.) The Board, instead of requiring any person to Exa~ nati? n pass an examination in all the prescribed subjects, may byUmverslty, accept in substitution for the whole or any part thereof a &e. Cel tificate of examination in any subject or subjects granted by any university, college, or board established in the Commonwealth of Australia, the United Kingdom of Great. Britain and Ireland, or any otlier part of His Majesty's Dominions, or by any public educational institution now or hereafter to be established in Queensland or the Commonwealth of Australia. The register shall at all times be open to inspec- tion by any person on payment of the prescribed fee. (3.) As soon as may be after every registration the registrar shall cause p;trticulars of such registration to be published in the Gazette. (4.) Every registered person shall be entitled to obtain from the registrar a certificate of his registration in the prescribed form. 15. Oertain 18. (1.) The Board shall, from time to time, erase ebenterireassemd.ay any entry in the register which is proved to the satisfaction of the :Board to have been fraudulently or incorrectly made. (2.) 'Every pharmaceutical chemist on changing his place of business shall forthwith give notice of thE' fact by post to the registrar. Every district registrar of deaths in Queensland on registering the death of any pharmaceutical chemist shall forthwith transmit notice thereof by post to the registrar.. (3.) The registrar shall, from time to time, erase the names of all pharmaceutical chemists who have ·died, and shall make such alterations and amendments in the register as the Board, from time to time, direct, for the purpose of making the same an accurate record of the names, addresses, and qualifications of the pharmaceutical chemists for the time being. l?or the purposes aforesaid, he may post a notice to any pharmaceutical chemist addressed to him according to his address in the register, inquiring whether he has changed his address or residence, and, if no answer is returned to such notice within six months after the posting thereof, the registrar shall erase the name of such person from the register. (4.) Any name erased from the register under this section may be restored by the Board upon payment of the prescribed restoration fee. Is, after due inquiry, adjudged by the Board to have been guilty of infamous conduct in a professional respect- shall be erased from the register: Provided that in the case of a charge of infamous conduct as aforesaid the Board, in making inquiry, shall, if so required by the person charged, sit as an open court, and the person charged shall be afforded an opportunity of defence either in person or by counsel, and shall have the right of appeal to·the Supreme Court, and such appeal shall be in the nature of a rehearing. The expression "infamous conduct in a professional respect" does not include any conduct which, either from its trivial nature or from the surrounding circumstances, does not in the public interest disqualify a person from carrying on the business of pharmaceutical chemist. (2.) Any name erased from the register under this section may be restored by the Board. 21. No. 11, chemist, or to assume or use the title of pharmaceutical chemist, pharmaceutist, pharmacist, chemist and druggist,. homeopathic chemist, dispensing chemist, or dispensing druggist, or other words of similar import, or to use or exhibit any title, term, or sign, which may be 'construed to mean that he is qualified to perform the duties of a pharmaceutical chemist, pharmaceutist, pharmacist, chemist and druggist, homeopathic chemist, dispensing chemist, or dispensing druggist. Any person offending against this section shall be liable to a penalty not exceeding twenty pounds and not less than three pounds: Provided that the sale in the ordinary course of business by any retail storekeeper or shopkeeper of any patent medicine or proprietary mp.dicine, or of any medicine or drug commonly sold in a bottle, tin, packet, or other container shall not be deemed to constitute the carrying on of the business of a pharmaceutical chemist. Exceptions as 24. The provisions of the last preceding section shall t ~ o aci f e r t ie ie n B d , l&y c. no t app 1 Y t 0 - (i.) A friendly society duly registered; or (ii.) The legal personal representatives of a phar- maceutical chemist actually carrying on busi- ness at the time of his death, who continue such business for a period not exceeding twelve months or for such further time as may be permitted by the Board; or (iii.) Any person taking possession of the stock-in- trade of a pharmaceutical chemist under a bond fide mortgage, and carrying cm such business for a period not exceeding twelve months, or for such further time as may be permitted by the Board- if and so long as the business carried on by such society or person is carried on under the actual personal supervi- sion and management of a pharmaceutical chemist, and the name of such chemist is set forth on every signboard, label, invoice, or other document, in which such title, term, sign, or words is or are used by such society or person. Any such society or person carrying o!l business contrary to this section shall, in addition to the penalty \

Pharmaoy Aot. 8329 prescribed in the last preceding section, be liable to a further penalty not exceeding ten pounds for every day during which the offence is continued after conviction. Any person aiding or abetting any such society or person in any such offence shall be liable to a penalty not exceeding twenty pounds and not less than three pounds. 25. ' attempt to carry on the business of or pretend to be pharmaceutical chemists, or to assume or use the title 'Of pharmaceutical chemists, pharmaceutists, pharmacists, chemists and druggists, homeopathic chemists, dispens- ing chemists, or dispensing druggists, or other words of similar import, or to use or exhibit any title, term, or sign which may be construed to mean that they are qualified to perform the duties of pharmaceutical chemists, pharma- ceutists, pharmacists, chemists and druggists, homeopathic chemists, dispensing chemists, or dispensing druggists. But this restriction shall not apply in the case of- (a) A company or association consisting wholly of pharmaceutical chemists; (b) A company carrying on in Queensland the business of pharmaceutical chemists, and duly registered before the first day of September, one thousand nine hundred and seventeen; (c) A friendly society duly registered; if and so long as every open shop or place of business of such company, association, or soeiety is carried on under the actual personal supervision and management of a pharma- ceutical chemist, and the name of such person is set forth on every signboard, label, invoice, or other document in which such title, term, sign, or words is or are used by such company, association, or society. . Any company, association, or society offending against this section shall be liable to a penalty not exceeding ten pounds f@r every day during' which the offence has con- tinued, which may be recovered by action in any court of competent jurisdiction at the suit of any person authorised by the Board in that behalf. Any person aiding or abetting any company, associa- tion, or society in any such offence shall be liable to a penalty not exceeding twenty pounds and not less than three pounds. .

This section shall not come into operation until the first day of January, one thousand nine hundred and nineteen. Board may sue. 27. (1.) The Board may, in their own name, by their registrar or by any person thereunto authorised in writing under the hand of the President, institute, carry on~ prosecute, and defend any action, complaint, information, or proceeding whatsoever. .' Every court of law shall take judicial notice of the signature of the President to any such authorisation. (2.) The conduct of proceedings in connection with complaints or charges against pharmaceutical chemists alleged to be guilty of infamous conduct in a professional respect; Apprentice. ship. Requiring and regulating the regi~tration in the office of the registrar of all contracts and articles of apprenticeship or p.upilage under whi~ h apprentices or pupils in pharmacy are servmg; (x.) Prescribing the course of study, professional practice, conditions of service, and training and examination of persons desirous of obtaining certificates of fitness entitling them to be registered as pharmaceutical chemists; grants from the funds of the Board in the encourage- ment or aid of professio)ml study and in- struction: Provided that the subjects for examina- tion at the preliminarv, intermediate, and final examinations respecti;ely shall be- Preliminary Examination. - Latin, English, Arithmetic, Algebra, and Geometry, to the standard required for the Junior }Jublie Examination of the Universitv of Queensland, or as approved by the Boa;d. Intermediate Examination.-Botany, Chemistry, Materia ::.vI edica, and Pharmacy. Final Examination.-Botany, Chem- istry (including Elementary Physics), Prac- tical Chemistry, Materia Medica, Pharmacy, Practical Pharmacy and Dispensing, and Prescriptions; Oertificates. (xi.) Regulating the granting of certificates of fitness; Open shops. (xii.) Requiring and regulating the registration m the office of the registrar of the names of every manager of any open shop or place of busine~ s carried on by any friendly society or person required by this Act to carry on the same under the actual personal supervision and management of a pharmaceutical chemist;
1917. MEDICAL. Pharmacy Act. 8333 (xiii.) Generally, for carrying into effect the objects of this Act with respect to matters of which the Board have cognisance; (2.) A By~ law may impose a penalty for any breach thereof, and may also impose different penalties in case of successive breaches. But no such penalty shall exceed twenty pounds. (3.) All such By~laws upon being so approved as afore~ said shall be published in the Gazette, and shall thereupon nave the same effect as if they were enacted in thia Act. The production of a copy of the Gazette containing a noti~ fication of the approval thereof by the Governor in Council :shall, in all proceedings,be sufficient evidence of such 1Jy~ laws. (4.) Any By-law or part of a By-law may be repealed by the Governor in Council by notification in the Gazette. 31. This Act does not apply to- Lim~ tat~ on of . . application of (1.) THE SCHEDULE. :PROVISIONS GOVERNING AND RELATING TO THE PROCEEDINGS A.ND BUSINESS OF THE BOA.RD. (1.) The President shall be the executive officer of the Board.' Executive officer. .(2.) Special meetings may be summoned at any time by the President, and shall be so summoned by him upon receipt of a requisition in writing signed by any two members. (4.) No business shall be transacted at any ordinary meeting of the Q,uorum. Board unless at least three of the members are present when such business is transacted. (5.) The President shall preside at all meetings at which he is Chairman. present. In the absence of the President, the members present shall elect from their number a chairman for the day.

The President, or in his absence the chairman for the day, shall have a vote, and, when there is an' equal division of votes upon any question, shall have a second or casting-vote. (6.) All powers vested in the Board may be exercised by the majority of the members present at any meeting duly held, and all questions shall be decided by a majority and by open voting. At all meetinglil, save as herein otherwise provided, all members present shall vote. If a m~mber refnses to vote, his vote shall be counted for the negative. (7.) No member shall vote or take part in any debate with respect to any matter in which he has directly or indirectly, by himself or; his partners, any pecuniary interest. Adjourn- ments. (8.) The members present at a meeting may, from time to time, adjourn the meeting. If a quorum is not present within half an hour after the time appointed for a meeting', the members present or the majority of them, or anyone member if only one is present, or the registrar if no member is present, may adjourn such meeting to any time not later than seven days from the date of such adjournment: Provided that nothing herein contained shall be construed to prevent the adjournment of any meeting to a later hour of the same day on which such meeting was appointed to be held. Notice of meetings. (9.) All notices of any meeting or adjourned meeting (other than of a meeting adjourned to a later hour of the same day on which such meeting was appointed to be held) shall be in writing, and shall be delivered, or sent by post or otherwise, to the address of each of the members previous to the meeting. Every such notice shall specify the time of meeting, and, in case of a special meeting, shall specify the object thereof. ' No business shall be transacted at any special meeting except such as is stated in the'notice thereof. . Proceedings validated. 0.0.) If any member refuses or neglects to act, or to attend any duly convened meeting of the Board, all lawful acts and proceedings of the Board shall be as valid and effectual as if they had been done or authorised by the full Board. . No proceedings of the Board or of any person acting as President shall be invalidated by reason of any defect in any appointment or election, or by reason of there being any vacancy in the number of members at the time of such proceedings, provided that the number of members is not reduced below three.
