PHARMACY ACT 1964—REGULATION

(Prescribing the period of work as an assistant required for registration

as a pharmacist)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Pharmacy Act 1964, has been pleased to make the Regulation set forth hereunder.

Commencement

1. This Regulation commences on 1 October 1995.

Amendment

2. The Pharmacy (General) Regulation 1993 is amended by omitting

clause 5 ( 1) and (2) and by inserting instead the following subclauses:

(1) For the purposes of section 13 (1) (b) of the Act, the prescribed

period as an assistant is 2,000 hours.

(2) In calculating the number of hours that a person has served as an

assistant, the following periods are not to be included:

(a) in the case of a person who has commenced a course leading to a first degree in pharmacy between 1 September 1993 and 1 October 1995:

(i)  any period served before the person’s successful completion of the first academic year of the course; and

(ii) any hours above 300 served during the period between the person’s successful completion of that year and the person’s successful completion of the course;

(b)

in the case of a person who commences a course leading to a first degree in pharmacy after 1 October 1995, any period served before the person’s successful completion of the course;

(c) in all cases:

(i)  any period of less than 30 hours served in any one week; and

(ii) any hours above 45 served in any one week; and

(iii)  any period of less than 150 hours served in any one location.

EXPLANATORY NOTE

Section 13 of the Pharmacy Act 1964 provides that a person is entitled to be registered as a pharmacist if the person satisfies certain requirements. Section 13 (1) (b)

requires a person to serve as an assistant for a prescribed period.

This Regulation provides that the required period is 2,000 hours. Previously, the number of hours that a student was required to work as an assistant depended on the level of the degree. If the degree was at pass level the prescribed period was 2,300 hours, and if the degree was at honours or postgraduate level the prescribed period was 2,000 hours. Now, all students are required to work 2,000 hours.

This Regulation also provides that some periods of service as an assistant cannot be counted in calculating the 2,000 hours. In particular, students who start their course after 1 October 1995 (the date this Regulation comes into effect) cannot count any period worked while undertaking the course. Students who started their course before 1 October 1995 will continue under the conditions that existed before 1 October 1995. Such students can count periods worked as an assistant after the student has completed the first year of their course, up to a maximum of 300 hours.

This Regulation is made under the Pharmacy Act 1964, including section 13 and section 38 (the general regulation making power), in particular section 38 (1) (i).
