PART 1—PRELIMINARY

101. Title

These Regulations may be cited as the

Pharmacists Regulations 1992.

102. Objectives

The objectives of these Regulations are—

(a)

to provide for the manner of application for registration, the form of the certificate of temporary registration and the form of the register; and

(ab) the form of application for endorsement of registration of a pharmacist under

section 16A of the Act; and reg. 4.

(b)

to provide for the prerequisite education and practical training of persons to be registered as pharmacists in Victoria; and

(c)

to provide for the standards of good pharmaceutical practice in the dispensing of drugs, advertising by pharmacists and the security of premises; and

(d)

to provide for the approval of pharmacy premises and the establishment of pharmacy depots; and

(e)

to prescribe fees payable under the Act to be used to meet the costs incurred in the administration of the Act; and

(f)

to prescribe the procedure for conducting elections of pharmacists as members of the Pharmacy Board of Victoria.

103. Authorising provisions

These Regulations are made under sections 4(1),
7, 12, 15, 16, 23, 24, 30 and 37 of the

Pharmacists Act 1974.

104. Definitions

In these Regulations—
"Act" means the Pharmacists Act 1974;
"pharmacy practical tutor" means a pharmacist

who conducts his or her practice on premises that have been approved by the Board for the purposes of section 12(1)(a)(i) of the Act.

PART 2—REGISTRATION

201. Application for registration

For the purposes of section 12 of the Act, an application for registration must be in writing and must include the following—

(a) the name and address of the applicant; and

(b) the qualifications held by the applicant; and

(c)

such information as to good character as may be required by the Board.

202. Form of certificate of temporary registration

For the purposes of section 16 of the Act, a certificate of temporary registration must be in the form of Schedule 1.

PART 3—PHARMACEUTICAL EDUCATION AND

TRAINING

301. Subjects in the course of practical training

For the purposes of section 12(1)(a)(i) of the Act, the prescribed course of practical training is one that includes instruction in the following topics—

(a) dispensing procedures and practice; and

(b) clinical pharmacy; and

(c)

treatment of commonly occurring minor ailments; and

(d) communication to patients, health
professionals and the community; and

(e) law applying to pharmacy practice; and

(f)

pharmacy and pharmacy department practice management; and

(g) good manufacturing practice; and

(h) drug information procedures.

302. Number of hours of practical training

For the purposes of section 12(1)(a)(i) of the Act, the prescribed number of hours is 2280 hours.

303. Conditions for practical training

(1) A student or trainee is not entitled to undertake

practical training until he or she has successfully
completed the Pharmacy I examination conducted

by the Board.

(2) A student or trainee may undertake a minimum of

132 hours and a maximum of 180 hours of practical training in any four week period.

(3) A student or trainee must not undertake more

than 456 hours of practical training until the
student or trainee has successfully completed the
Pharmacy III examination conducted by the
Board.

(4) A student or trainee must undertake a minimum of

152 hours of practical training under the direct
supervision of one pharmacy practical tutor.

304. Subjects for course of instruction

For the purposes of section 12(1)(a)(ii) of the Act, the subjects prescribed for the course of instruction at the Victorian College of Pharmacy Limited are—

(a) Pharmaceutics;

(b) Pharmaceutical Chemistry;

(c) Pharmacology;

(d) Pharmacy Practice;

(e) Pharmaceutical Microbiology.

305. Subjects for final examination

For the purposes of section 12(1)(a)(iv) of the Act, the subjects prescribed for the final examination conducted by the Board are Forensic Pharmacy and Pharmacy Practice.

306. Retraining programs for restoration

(1) If a person does not apply for registration within 2 years of being qualified for registration and has not in that period practised as a pharmacist or if an

applicant for restoration has not practised as a
pharmacist for more than 2 years, the Board may
require the applicant to undertake one or more of
the following programs prior to the restoration of
registration—

(a) a period of retraining under the supervision of a pharmacy practical tutor;
(b)

concerning contemporary professional

participation in a refresher or re-entry course approved by the Board;

(c)

study of specific subjects or part of the academic course at a tertiary institution approved by the Board.

(2) If the Board is not satisfied that an applicant is

competent to practise pharmacy after completing a or more further programs.

307. Training agreements

(1) A trainee must enter into an agreement for articles

of traineeship with a pharmacy practical tutor
before commencing a course of practical training.

(2) The trainee must lodge—

(a) a copy of the articles of traineeship; and

(b) the prescribed fee under Part 6—

with the Registrar within 30 days after it is signed

by both parties.

PART 4—PRACTICE AS A PHARMACIST

Division 1—Dispensing

401. Pharmacist to be in attendance

Subject to section 28 of the Act, a pharmacist in charge of a pharmacy or a pharmacy department must not allow a person to have access to a

pharmacy or pharmacy department unless a

pharmacist is present.

402. Dispensing precaution

A pharmacist must dispense a drug or medicine in accordance with the prescription as far as it is consistent with the safety of the patient.

403. Record of dispensing

(1) For the purposes of section 30 of the Act, the

record must be written in English and must

include—

(a)

the name and address of the patient for and

(b)

the date of dispensing or supply of the drug or the medicine; and

(c)

the name and dose form of any drug or medicine so dispensed or supplied; and

(d) the strength or identifying formula; and

(e) the quantity or number of doses ordered; and

(f) the directions for use; and

(g)

any other ancillary written instructions supplied on the label; and

(h) the name of the prescriber, or if the medicine is supplied on the order of a pharmacist, the name of that pharmacist; and

(i)  any alteration to the original prescription; and

(j)

any other information concerning the medicine or its use.

(2) In addition to the details required in sub-

regulation (1), the record must—

(a)

be retained in a secure place at the pharmacy or pharmacy department for at least three years; and

(b)

be made at the time of dispensing or supply, or in the case of emergency, within 24 hours thereafter; and

(c)

be certified by the dispensing or supplying pharmacist with his or her handwritten signature within 24 hours of the dispensing or supply—

(i) in the prescription record; or

(ii)

in a manner which precludes

where the prescription record is made record kept for that purpose—

that he or she dispensed the prescription or order and the certified record must form a part of the prescription record; and

(d)

be readily retrievable by reference to the name and address of the patient or the date of dispensing or supply or from information on the label on the container.

Division 2—Advertising

404. Advertising content

A pharmacist must not advertise, or permit any other person to advertise, his or her practice in a manner which—

(a) is false, deceptive or misleading; or

(b) contains a statement in respect of any drug, medicine or surgical appliance, other than a statement that factually describes that

product and its intended use and that the product is available at the pharmacy; or

(c)

directly or indirectly encourages the indiscriminate or unnecessary use of drugs or medicines.

PART 5—PREMISES

Division 1—Pharmacies and Pharmacy Departments

501. Manner of application for approval of premises

For the purposes of section 23 of the Act—

(a)

an application for approval of a premises for the establishment of a pharmacy or a pharmacy department or for alteration of parts of approved premises set aside for compounding or dispensing drugs must—

(i) be in writing; and

(ii)  include the name and address of the applicant; and

(iii)  include the address of the premises or pharmacy; and

(iv)  include plans and specifications of the premises or alterations proposed to be made; and

(v)  contain such other information as may be required by the Board; and

(b)

an application must be accompanied by the appropriate fee prescribed in Part 6.

502. Criteria for approval

For the purposes of section 24 of the Act, the Board must be satisfied that the premises of a pharmacy or a pharmacy department is suitable,

secure, hygienic and adequately equipped.

Division 2—Pharmacy Depots

503. Approval of pharmacy depots

A pharmacist may, with the written approval of the Board, establish a pharmacy depot at which medicines dispensed by the pharmacist may be left for collection by the addressee.

504. Management of pharmacy depot

(1) A person under the age of 18 must not be in

charge of a pharmacy depot.

(2) The person in charge of a pharmacy depot must

keep medicines left for collection at the depot
secure until collected by the persons to whom they
are addressed.

PART 7—ELECTIONS OF PHARMACISTS TO PHARMACY

BOARD

701. Conduct of elections

Elections of pharmacists for appointment as
members of the Board under section 4(1)(f) of the
Act must be conducted in accordance with this

Part.

702. Returning officer

The Registrar is the Returning Officer for the conduct of elections under this Part.

703. Poll clerks

The Returning Officer may appoint persons as poll clerks to assist in the conduct of an election.

704. Polling day

(1) The Returning Officer must determine the polling day for an election.

(2) The polling day must be at least 21 days before

the vacancy to be filled by the election occurs.

705. Nomination day

(1) The Returning Officer must determine the

nomination day for an election.

(2) The nomination day must be at least 21 days

before the polling day for the election.

706. Notice of election

(1) The Returning Officer must give notice of an election in a publication circulating generally among pharmacists in Victoria.

(2) The notice must be given not less than 1 month and not more than 3 months before the polling day.

(3) The notice must specify—

(a) the nomination day;

(b)

the place where nominations will be received;

(c) the polling day;

(d)

the name and address of the Returning Officer.

707. Method of nominating

A pharmacist who intends to be a candidate at an election must cause a nomination paper to be delivered to the Returning Officer not later than 12 noon on the nomination day.

708. Form of nomination paper

A nomination paper must—

(a) be in the form of Schedule 3; and

(b)

be signed by 2 pharmacists other than the candidate; and

(c) bear the written consent of the candidate.

709. Withdrawal of nomination

(1) A pharmacist nominated for an election may

withdraw from the election by giving a written
notice of withdrawal to the Returning Officer not
later than 12 noon on the nomination day.

(2) The Returning Officer must not include the name

of any pharmacist who withdraws under sub-
regulation (1) in any ballot paper for the election.

710. Uncontested election

(1) If the number of nominations does not exceed the

number of vacancies to be filled, the Returning pharmacists elected for appointment to the Board.

(2) If there are insufficient nominations for the

number of vacancies to be filled the Returning with this Part before the end of 3 months after the vacancy occurs.

(3) Regulation 704(2) does not apply to an election held under sub-regulation (2).

711. Death of a candidate

(1) If a candidate dies before 12 noon on nomination

day, these regulations apply as if the candidate's
nomination were withdrawn.

(2) If a candidate dies after 12 noon on nomination

day and before the ballot papers for an election are
sent out under regulation 714, the Returning

Officer—

(a) must not include the candidate's name on the ballot papers; or
(b)

if the ballot papers have already been be struck out on each ballot paper before it is sent out.

(3) If a candidate dies after the ballot papers for an

election have been sent out, the Returning Officer
must cancel the election and may hold another
election in accordance with this Part before the
end of 3 months after the vacancy occurs.

(4) Regulation 704(2) does not apply to an election held under sub-regulation (3).

712. Contested election

If there are more nominations than the number of vacancies to be filled, the Returning Officer must conduct a poll by postal ballot.

713. Ballot paper

The Returning Officer must cause ballot papers to be printed in the form of Schedule 4 showing the surnames and given names in full of all candidates at the election in alphabetical order of surnames.

714. Distribution of ballot papers

At least 14 days before polling day, the Returning Officer must send to the registered address of each pharmacist registered under the Act—

(a)

a ballot paper initialled or signed by the Returning Officer or a poll clerk; and

(b)

a ballot envelope printed with the words "Place ballot paper only in this envelope";

(c)

an unsealed return envelope addressed to the Returning Officer.

715. Method of voting

(1) A pharmacist must cast his or her vote by marking

the letter "X" in the square opposite the names of
the candidates for whom he or she is voting.

(2) To record a valid vote, a pharmacist must mark a

number of squares equal to the number of
vacancies to be filled.

(3) A pharmacist is entitled to vote once only at each

election.

716. Manner of lodging vote

After marking the ballot paper, the pharmacist must—

(a) place and seal it in the ballot envelope; and

(b)

place the ballot envelope in the return envelope; and

(c)

sign and write his or her name and registered address on the back of the envelope; and

(d) seal the envelope; and

(e)

post or deliver the return envelope, or cause the return envelope to be delivered, to the Returning Officer before 12 noon on the polling day.

717. Duplicate ballot papers

The Returning Officer may issue a duplicate ballot paper to a pharmacist before 12 noon on polling day if the pharmacist makes and causes to be delivered to the Returning Officer a declaration—

(a)

that he or she has not received a ballot paper; or

(b)

that the ballot paper he or she received has been lost, spoilt or destroyed.

718. Provision of ballot box

The Returning Officer must provide a sealed
ballot box and place unopened in the ballot box all

envelopes received before 12 noon on polling day.

719. Scrutineers

Each candidate at an election is entitled to appoint, in writing, one scrutineer to be present during the scrutiny, examination and counting of votes.

720. Scrutiny of envelopes

As soon as practicable after 12 noon on polling day, the Returning Officer, in the presence of any scrutineers that choose to be present, must—

(a) open the ballot box; and

(b)

produce all return envelopes received before 12 noon on polling day; and

(c)

examine each envelope and if it is signed by a pharmacist and bears the pharmacist's name and registered address accept the vote for further scrutiny;

(d)

if an envelope is not properly signed by a pharmacist or does not otherwise comply with regulation 716, reject the vote without

opening the envelope and mark the envelope
rejected;

(e)

open each accepted envelope and extract the ballot-paper envelope;

(f)

open each ballot envelope, withdraw the ballot paper and without inspecting the vote or permitting any other person to do so, deposit the ballot paper in the ballot-box;

(g)

when all accepted envelopes have been opened and ballot papers deposited in the ballot-box open the ballot-box and count the votes.

721. Invalid votes

A ballot paper must not be counted if—

(a)

it is not enclosed in a return envelope properly signed by a pharmacist and bearing the pharmacist's name and registered address; or

(b)

it does not contain the letter "X" in or substantially in each of the required number of squares opposite the names of the candidates for whom the pharmacist is voting; or

(c)

it contains the letter "X" in squares opposite the names of more or less than the number of candidates to be elected.

722. Adjournments

The Returning Officer may from time to time adjourn the scrutiny of envelopes or the counting of votes to a time and place fixed by the Returning Officer and notified to the scrutineers.

723. Result of election

At the conclusion of the counting of the votes, the Returning Officer must declare the candidate or candidates (as the case requires) who have received the greatest number of votes elected.

724. Equal votes

If at an election 2 or more candidates receive an equal number of votes which is greater than the number of votes received by any of the remaining

candidates, the Returning Officer must decide by
lot which of the candidates is to be declared

elected.

725. Recounts

(1) The Returning Officer may, at any time before the declaration of the poll—

(a)

at the written request of any candidate stating the reasons for the request; or

(b) on his or her own initiative—

recount the votes.

(2) The Returning Officer must advise all candidates if a recount is to be conducted.

(3) If the Returning Officer refuses the request of a

candidate to make a recount, the candidate may, in
writing, appeal to the Governor in Council to
direct a recount.

(4) The Returning Officer must comply with any

direction by the Governor in Council on appeal to
recount the votes.

726. Report of election

After the declaration of the poll, the Returning
Officer must submit a written report to the

Minister of the result of the election setting out—

(a) the names of the candidates nominated; and

(b)

the number of votes polled by each candidate; and

(c) the number of informal votes; and

(d) the names of the candidates elected.

727. Destruction of papers

The Returning Officer must cause all ballot papers and envelopes used at the election to be destroyed at the end of 3 months after submitting the report to the Minister of the result of the election.

11 August 1992 by the Deputy Governor in Council, on the recommendation
of the Pharmacy Board of Victoria, under sections 4(1), 7, 12, 15, 16, 23, 24,
30 and 37 of the Pharmacists Act 1974, No. 8593/1974 and came into
operation on 11 August 1992.
The Pharmacists Regulations 1992 will sunset on 10 August 2003: see the
Subordinate Legislation (Pharmacists Regulations 1992—Extension of
Operation) Regulations 2002, S.R. No. 64/2002 reg. 3.
