CaseChat Overview and Summary
The court was tasked with determining whether the enterprise agreement provided employees with a better overall financial outcome compared to the applicable awards, and whether it adhered to the procedural and substantive requirements outlined in the Fair Work Act. Specifically, the court examined whether the agreement contained all the mandatory terms as prescribed by the Act, and whether it complied with the good faith bargaining provisions.
In its reasoning, the court found that the enterprise agreement did indeed provide employees with a better overall financial outcome, as it included provisions for higher wages and better working conditions compared to the applicable awards. The court also confirmed that the agreement complied with the mandatory terms and good faith bargaining requirements of the Fair Work Act. Therefore, the court approved the enterprise agreement, registering it under the Act.
The final orders of the court were that the PFD Food Services Pty Ltd (Rockhampton) Enterprise Agreement 2019 be registered under section 178 of the Fair Work Act 2009, effective from the date of the registration. This decision allowed the enterprise agreement to be in force and binding on the parties involved.
