Petroleum (Submerged Lands) (Occupational Health and Safety) Regulations 2(Amendment)

I, The ADMINISTRATOR of the Government of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Petroleum (Submerged Lands) Act 1967.

1.   Amendment

1.1   The Petroleum (Submerged Lands) (Occupational Health and Safety) Regulations are amended as set out in these Regulations.

[NOTE:

 These Regulations commence on gazettal: see Acts Interpretation Act 1901, s. 48.]

2.   New regulation 4A

2.1   After regulation 4, insert:

Avoidance of fatigue of persons engaged in operations

“4A.

An employer must not allow or require an employee or contractor to engage in an activity to which Part III of the Act applies for:

  • (a)

    a continuous period of such duration; or

  • (b)

    successive continuous periods of such combined duration;

as may reasonably be expected to affect adversely the health or safety of the employee or contractor or of another person.

[NOTE:

 The Department of Primary Industries and Energy has published a guideline setting out the safe working periods recommended by the Department.]”.
